There is established the Town of Milton Planning Commission.

A. 
The Town Planning Commission shall consist of not less than five nor more than nine members to be appointed by the Mayor, subject to the confirmation by a majority of the elected members of the Council for a term of three years.
B. 
The terms of the members of the Planning Commission first appointed pursuant to this chapter shall expire as follows:
(1) 
Three members shall be appointed for a term of three years;
(2) 
Three members shall be appointed for a term of two years; and
(3) 
Three shall be appointed for a term of one year.
The Mayor and Council Secretary shall be ex officio members of the Planning Commission. An ex officio member may exercise all the powers of the regular members of the Planning Commission. No ex officio member shall have or hold an office on the Planning Commission.
A. 
Any member of the Commission may be removed for cause after a public hearing by the Mayor with the approval of a majority of the Council.
B. 
Vacancies occurring other than by expiration of term shall be filled for the unexpired term by the Mayor, subject to approval by a majority of the Council.[1]

All members shall serve without compensation but may be reimbursed for actual expenses incurred in connection with their official duties.
The Planning Commission shall elect annually a Chairman and a Secretary from among its members and may employ experts, clerks, and such other assistance that its fiscal appropriations shall permit. The Planning Commission may also appoint a custodian of its plan and records, who may be Town Clerk.
The Commission shall make its own rules of procedure and determine the time of its meetings. All meetings of the Planning Commission at which any official action is taken shall be open to the public. All records of the Commission shall be public record.
The Planning Commission shall have the authority vested in municipal planning commissions by Chapter 7, Title 22, Delaware Code, 1953,[1] as amended, and shall perform the duties therein set forth, whether or not such authority or duties are expressly referred to herein.
