A portion of each street which has a right-of-way at least 30
feet in width shall be set aside for required sidewalk areas as follows:
A. Width. On each side of all streets which have a right-of-way of 80
feet or more in width, the required sidewalk area shall be six feet
wide; on each side of all streets which have a right-of-way of less
than 80 feet in width, the required sidewalk area shall be four feet
wide.
B. Location. The required sidewalk area shall, as much as possible,
be located parallel to and be of a uniform distance from the curbline
on each street for the entire length of the street. The Borough Engineer
shall determine the location of the required sidewalk area along any
new Borough street or along any existing street where the location
cannot otherwise be determined.
On any sidewalk being installed, repaired or replaced, the width of the pavement shall coincide with the space allotted for the required sidewalk area as defined in §
135-29 above. Except where necessary to preserve shade trees, as determined by the Borough Engineer, the paved width of existing sidewalks shall not be reduced to less than the required sidewalk area.

Any person, firm or corporation who shall violate any provision
of this article shall, upon conviction thereof before the Magisterial
District Judge, be subject to a fine not exceeding $600, plus costs
of prosecution, and, in default of payment, imprisonment for a term
not exceeding 30 days.
