This article is enacted pursuant to Article 41 of the Vehicle
and Traffic Law of the State of New York to further the purposes set
forth herein, including but not limited to promoting the general health,
safety and welfare of the community, including regulation of certain
driveways and parking areas within the Town for the purpose of promoting
driver and pedestrian safety within said areas and for the purpose
of preserving and protecting the property of owners within the Town
and promoting firesafety for said properties.
For the purpose of this article, all terms used herein shall
be interpreted and construed as provided in the Vehicle and Traffic
Law of the State of New York.
Upon the application to the Town Board by an owner or other
person in general charge of the operation and control of a shopping
center or private apartment-house complex located within the Town
and approval of said application by the Town Board, the Town Superintendent
of Highways or the applicant, as so designated by the Town Board,
may install one or more traffic control devices or signs within the
private driveways, streets, roadways or parking areas of the shopping
area or private apartment-house complex to do one or more of the following:
A. Through the installation of stop signs, flashing signals or yield
signs at entrances or exits to any such area, designate any intersection
at such area as a stop intersection or as a yield intersection.
B. Regulate traffic at any such area, including regulation by means
of traffic control signals.
C. Prohibit or regulate the turning of vehicles or specified types of
vehicles at intersections or other designated locations in any such
area.
D. Regulate the crossing of any roadway in any such manner by pedestrians.
E. Designate any separate roadways in any such area for one-way traffic.
F. Prohibit, regulate, restrict or limit the stopping, standing or parking
of vehicles in specified areas of any such area.
G. Designate safety zones in any such area.
H. Provide for the removal and storage of vehicles parked or abandoned
in any such area during snowstorms, floods, fires or other public
emergencies or found unattended in any such area where they constitute
an obstruction to traffic or where stopping, standing or parking is
prohibited, and for the payment of reasonable charges for such removal
and storage by the owner or operator of any such vehicle.
The approval by the Town Board of any application for regulation
as provided herein shall be preceded by a public hearing upon 10 days'
notice published and posted in accordance with the provisions of the
Town Law of the State of New York.
All traffic control devices, signs or other markings installed
pursuant to order and approval of the Town Board shall be installed
in accordance with the provisions of the Vehicle and Traffic Law of
the State of New York and other appropriate regulation.

The penalties for violation of the provisions of this Article
III shall be as provided in §
97-9 of the Town Code.
The application for any permission herein shall be accompanied
by a fee in an amount specified from time to time by resolution of
the Town Board.
