The Board of Trustees of the Village of Saddle Rock declares and finds it to be in the public interest and for the public good and to preserve the property values in the Village of Saddle Rock and for other aesthetic considerations to provide for the regulation of signs and attracting devices within the Village of Saddle Rock.
As used in this chapter, the following words and phrases shall have the following meanings:
ATTRACTING DEVICE
Any device other than sign, including a banner, pennant, bunting, streamer, colored strip or panel, flame, decorative light, trade flag or similar device, which is visible from a public street or sidewalk, including a device on or behind a window or glass door and which alone or in combination with other devices or signs is intended to attract the public to the premises to which the device is appurtenant.
SIGN
Informational material, such as a word, abbreviation, letter, punctuation mark, trademark symbol or shape, as well as representation by picture, model, drawing or similar means, which is visible from a public street or sidewalk, including material on or behind a window or glass door, and which informs the viewer about the item, thing or subject referred to, including its identity or location. A "sign" shall not include any flag, emblem, insignia or display incidental to and customarily or commonly associated with any national, local or religious holiday nor any informational device erected or maintained by a governmental authority.
A. 
No sign or attracting device shall be placed or maintained in public view within the Village of Saddle Rock until a permit has been duly issued upon application therefor.
B. 
No more than one sign or attracting device permit may be in effect at any one time for any single piece of property.
C. 
Every application for a permit shall indicate the proposed location of the sign or attracting device, which shall in no case be more than four feet from the nearest wall of the dwelling or principal building on the property.
D. 
The application shall state the period of time for which the permit is requested. The Village Clerk may issue any permit the application for which conforms to the requirements of this chapter, provided that the duration of display of the sign or attracting device shall not exceed 60 days. In the event that the applicant requests a period of display in excess of 60 days, no such permit shall be granted except by the Board of Trustees.
E. 
Fee. The fee for a permit pursuant to this chapter shall be established by resolution of the Board of Trustees and shall be paid to the Village at the time the application for a permit is presented.
A. 
Signs and attracting devices must be removed no later than the date of expiration of the permit for the sign or attracting device.
B. 
Any sign or attracting device which does not conform to the requirements of this chapter may be removed by the Village without notice to the property owner or the owner of the sign or attracting device.
Any person who violates any of the provisions of this chapter and the owner of any property on which any sign or attracting device is displayed in violation of this chapter and the owner of any such sign or attracting device which is displayed in violation of this chapter shall be guilty of a violation punishable by a fine not to exceed $250. Each continuous period of seven days in which such violation continues shall constitute a separate and distinct additional violation.
The Building Official of the Village of Saddle Rock shall have power and authority to enforce the provisions of this chapter. Such authority shall be in addition to any other enforcement authority provided by law.
