No person who owns or is in charge of any chickens, geese, ducks, turkeys, or other fowl shall permit the same to run at large upon a public place, unenclosed lands or the premises of another.
Except as provided in § 3-509.7 of this chapter, no person shall be permitted to own, harbor or maintain more than five animals, regardless of species, within the City limits in one residence or building. This requirement shall be in addition to § 3-505.6. In no event shall the maximum number of animals upon any residence or household within the City limits exceed 10 animals. This section shall not affect any person or resident whose number of animals other than dogs or cats exceeds the limit of five prior to the effective date of this section, except that upon elimination of said animals by adoption, death or any permanent removal from that residence or building, the limit of five may not be exceeded. This section shall not affect any person or residence that has been granted an exemption permit by the Animal Control Section. This permit shall be granted at the sole discretion of the Animal Control Section to those persons or residences that provide temporary foster care and do placement work. There shall be no fee for the exemption permit. However, at no time shall the number of animals, including dogs and cats or combination thereof, exceed 10 being owned, harbored or maintained in the residence or building granted an exemption permit.
A. 
Under the provisions of this chapter, no owner, breeder, kennel/cattery or other entity harboring, keeping or maintaining any animal shall fail to provide such animal with sufficient and wholesome food and water, proper shelter and protection from the weather, veterinary care when needed to prevent suffering, and humane care and treatment, including sufficient exercise space.
B. 
No person shall beat, cruelly mishandle, ill treat, torment, overwork, overload, or otherwise abuse any animal or cause, instigate or permit any dog fight, cat fight, cock fight, bull fight, or other combat between animals or between animals and humans.
C. 
No owner or keeper of an animal shall abandon such animal.
D. 
Any person who, as the operator of a motor vehicle, strikes a domestic animal shall stop at once and render such assistance as may be possible and shall immediately report such injury or death to the animal's owner. In the event that the owner cannot be ascertained and located, such operator shall at once report the accident to the Bureau of Police.
E. 
No person shall expose any known poisonous substance, whether mixed with food or not, so that the same shall be liable to be eaten by any animal, provided that it shall not be unlawful for a person to expose on his property an anticoagulant rat or mice poison and/or the type of rat or mice poison commonly known as "red squill" and other rat or mice poisons approved by the Chief of Police.

No person shall ride or drive any animal-drawn conveyance on any street or sidewalk within the City, except as the Chief of Police or Director of Parks, Recreation and Enrichment may permit, and except that the Director of the Department of Parks, Recreation and Enrichment may authorize horse-drawn carriages on designated streets in the City at designated times.
A. 
No person shall keep or permit to be kept on his or her premises any wild animal or vicious or dangerous animal for display or for exhibition purposes, whether gratuitously or for a fee. This section shall not be construed to apply to zoological parks, performing animal exhibitions, or circuses.
B. 
No person shall keep or permit to be kept any wild animal as a pet without a permit from the City.
C. 
The City may issued a temporary permit for the keeping, care and protection of an infant wild animal native to this area which has been deemed to be homeless.
D. 
The Chief of Police shall have the power to release or order the release of any infant wild animal kept under temporary permit which is deemed capable of survival.

No person shall be permitted to own, harbor or maintain a wolf or wolf hybrid or nondomestic cat or nondomestic cat hybrid within City limits. This section shall not affect any such animal owned by a person living within the City limits prior to the effective date of this chapter.
A. 
Unless otherwise permitted by the Chief of Police, the keeping or maintaining of any farm animal, with the exception of poultry, shall be permitted only on land of sufficient area so that there shall be 60,000 square feet for the first animal with 20,000 square feet for each additional animal. There shall also be provided a pen or enclosure of at least 1,600 square feet for the first animal, with 400 square feet of pen or enclosure required for each additional animal. Within the pen there must be provided a stable or similar roofed enclosure having an area of at least 100 square feet for each animal to be held therein. Any such pen or enclosure shall be situated not less than 100 feet from any street or other property line.
B. 
The keeping or maintaining of poultry shall be permitted only on a lot within a land area equivalent to 40,000 square feet or more. In no event shall more than 10 poultry birds be permitted on each 40,000 square feet area. The pen, shelter or enclosure shall be set no closer than 75 feet to the front lot line nor closer than 75 feet to any side or rear line.
C. 
"Poultry" is defined as ducks, chickens, swans, geese, turkeys, guinea fowl, pheasants, pea fowl, and pigeons.
D. 
The owner or person(s) responsible for the care and keep of such animals shall be responsible to prevent or eliminate all odors, animal waste and insect infestation caused by the maintenance of such animals.
A. 
Unless otherwise provided, any person violating § 3-509.1 or 3-509.2 of this chapter shall be fined $25, plus costs, if it is a first offense. The penalty shall be $300, plus costs, for subsequent offenses.
B. 
Every separate act and every day in violation of any other provision of this chapter shall be deemed a separate and distinct offense and shall be punishable by a fine not to exceed $1,000 and/or a term of imprisonment not to exceed 30 days, plus costs.
C. 
Anyone convicted under § 3-509.3 twice within any twelve-month period shall forfeit the right to own, possess or have under his or her control any domestic animal or fowl for a period of two years beginning from the date of the second conviction. Anyone found in violation hereof shall be subject to a fine of $500, plus costs, and, in default thereof, imprisonment not exceeding 72 hours.
