Effective January 1, 1986, every dwelling unit shall be supplied
by the occupant with approved ash, garbage and rubbish storage receptacles,
except that in the case of multifamily dwellings, rooming houses,
hotels and motels, the owner or operator shall be responsible for
supplying such receptacles.

Every other building in which rubbish or garbage is produced
by reason of the activity carried on therein shall be supplied by
the occupant with approved garbage and rubbish storage facilities.

Every dwelling unit or other building in which ashes are produced
from coal or other fuels used for heating or cooking purposes shall
be supplied by the occupant with approved ash storage facilities.
Effective January 1, 1986, garbage receptacles shall:
A. Be made of durable, watertight, rust-resistant material, such as
metal or plastic;
B. Have a tight-fitting lid which shall be kept on the receptacle at
all times except when depositing or removing refuse;
C. Have a capacity of not less than 10 gallons;
D. Be kept in good condition so as to be free of leakage or drainage;
and
E. Be kept clean by thoroughly rinsing and draining as often as necessary
so as not to provide food, harborage or a breeding area for insects,
birds or other vectors.

Rubbish receptacles shall be made of metal or other strong material
impervious to water of a capacity of not less than 1/2 bushel nor
more than two bushels and shall be kept in good condition. Any such
receptacle not having a lid shall be so used as to prevent the falling
or dumping of rubbish upon the premises or streets.

Ash receptacles shall be made of metal, with tight-fitting lids,
of a capacity of not more than one bushel and shall be kept in good
condition.

Garbage shall not be deposited in the same receptacle as that
for rubbish or ashes.

The occupant of every dwelling unit shall store garbage, rubbish
and ash receptacles and recycling containers upon the premises and
outside the habitable rooms thereof. Such receptacles shall not be
stored upon fire escapes, on the streets, sidewalks or other public
places, except that during a twelve-hour period prior to the announced
time of collection by the Bureau of City Services, all receptacles,
containers and recycling containers may be placed on the sidewalk
nearest the point of collection. Garbage receptacles shall not be
stored within any dwelling.
The provisions of Chapter
9-309 are incorporated here as if fully set forth.
Any person who violates the provisions of this chapter shall be subject to Chapter
6-103, Enforcement and Penalty, of these Codified Ordinances.
