This article shall be known and may be cited as the "Village of Roslyn Garage and Tag Sales Law."
For the purposes of this article, the following terms shall have the meanings indicated:
GARAGE SALE
All sales titled "garage sale," "lawn sale," "attic sale," "rummage sale," "tag sale" or "flea market sale" or any similar casual sale of tangible personal property in any area, other than a business zone where such use is permitted, which is advertised by any means whereby the public at large is or can be made aware of said sale.
GOODS
Only used goods, merchandise, wares, or other personal property capable of being the object of a sale regulated hereunder.
It shall be unlawful for any person to conduct a garage sale in the Village without first obtaining a permit and complying with the regulations set forth herein.
A. 
All persons wishing to conduct a garage sale in the Village shall make application to the Department of Building and Code Enforcement.[1]

B. 
Application for a permit to conduct a garage sale shall be made in writing on a form prescribed by the Village Clerk/Treasurer and presented to the Department of Building and Code Enforcement.[2]

C. 
The applicant who wishes to conduct a garage sale in the Village shall provide the following information in connection with his or her application for a permit:
(1) 
Name of the person intending to conduct the sale.
(2) 
Name of the owner of the property on which the garage sale is to be conducted and the consent of the owner if the applicant is other than the owner.
(3) 
Location at which the garage sale is to be conducted.
(4) 
Dates on which the garage sale is to be conducted.
(5) 
Date and permit number for any prior garage sale.
(6) 
Relationship or connection the applicant may have with any other person conducting the garage sale.
(7) 
Whether or not the applicant has been issued any other vendor's license by any local, state, or federal agency.
(8) 
Sworn statement or affirmation by the person signing the application that the information therein given is complete and true and known by such person to be so.
D. 
All applications for a permit to conduct a garage sale shall be accompanied by the payment of a fee for the permit and a fee for the use of signs to advertise the sale. The fee for such permits shall be set from time to time by resolution of the Board of Trustees.
E. 
Once issued by the Village Clerk/Treasurer, the permit authorizing the garage sale is to be prominently displayed on the property during the entire time the sale is being conducted.
After issuance by the Village Clerk/Treasurer of a permit to conduct a garage sale in the Village of Roslyn, a garage sale may be conducted subject to the following regulations:
A. 
Only goods owned by the resident of the property where the garage sale is held may be offered for sale.
B. 
Garage sales shall not begin on weekdays and Saturdays before 10:00 a.m. and must terminate by 5:00 p.m. On Sundays, garage sales shall not begin before 12:00 noon and must terminate by 5:00 p.m.
C. 
No person shall conduct more than one garage sale on his or her premises in any one calendar year.
D. 
No garage sale may extend for a period of more than two days.
E. 
No more than 50 persons shall be permitted in attendance at any garage sale at any one time.
F. 
Advertisements.
(1) 
Garage sales may be advertised in newspapers or in other media.
(2) 
A maximum of two signs, not greater in size than two feet by two feet, may be installed on the property where the sale is being conducted. Any such signs shall conform to the requirements of Chapter 470, Zoning, of this Code.
(3) 
No sign shall be placed on the public right-of-way or upon utility poles or on property other than where the sale is being conducted.
(4) 
No lighted signs shall be used.
(5) 
Any signs to be used for advertisement purposes shall be displayed only during the hours of sale and shall be removed at the conclusion of the sale.
G. 
This article is not intended to change or amend the Chapter 470, Zoning, of this Code.
The provisions of this article shall not apply to or affect the following persons or sales:
A. 
Persons selling goods pursuant to an order or process of a court of competent jurisdiction.
B. 
Persons acting in accordance with their powers and duties as public officials.
C. 
Any sale conducted by any merchant or other business wherein such sale would be permitted by the zoning laws of the Village or under the protection of the nonconforming use section thereof[1] or any other sale conducted by a manufacturer, dealer, or vendor and which sale would be conducted from properly zoned premises and not otherwise prohibited.

D. 
Any bona fide charitable, eleemosynary, educational, cultural or governmental institution or organization; provided, however, that the burden of establishing the exemption under this subsection shall be upon the organization or institution claiming such exemption.
A. 
This article shall be enforced by the Village Superintendent of Buildings, Code Enforcement Officers and the Nassau County Police Department.
B. 
The person to whom such permit is issued and the owner or tenant of the premises on which such sale or activity is conducted shall be jointly and severally responsible for the maintenance of good order and decorum on the premises during all hours of such sale or activity. No such person shall permit loud or boisterous conduct on said premises or permit vehicles to impede the passage of traffic on any roads or streets in the area of such premises. No loudspeakers may be used at any time. All such persons shall obey the reasonable orders of any member of the Police Department or Fire Department or the Superintendent of Buildings or Code Enforcement Officers of the Village in order to maintain the public health, safety and welfare.
