This article shall be known and may be cited as the "Village
of Roslyn Garage and Tag Sales Law."
For the purposes of this article, the following terms shall
have the meanings indicated:
GARAGE SALE
All sales titled "garage sale," "lawn sale," "attic sale,"
"rummage sale," "tag sale" or "flea market sale" or any similar casual
sale of tangible personal property in any area, other than a business
zone where such use is permitted, which is advertised by any means
whereby the public at large is or can be made aware of said sale.
GOODS
Only used goods, merchandise, wares, or other personal property
capable of being the object of a sale regulated hereunder.
It shall be unlawful for any person to conduct a garage sale
in the Village without first obtaining a permit and complying with
the regulations set forth herein.
After issuance by the Village Clerk/Treasurer of a permit to
conduct a garage sale in the Village of Roslyn, a garage sale may
be conducted subject to the following regulations:
A. Only goods owned by the resident of the property where the garage
sale is held may be offered for sale.
B. Garage sales shall not begin on weekdays and Saturdays before 10:00
a.m. and must terminate by 5:00 p.m. On Sundays, garage sales shall
not begin before 12:00 noon and must terminate by 5:00 p.m.
C. No person shall conduct more than one garage sale on his or her premises
in any one calendar year.
D. No garage sale may extend for a period of more than two days.
E. No more than 50 persons shall be permitted in attendance at any garage
sale at any one time.
F. Advertisements.
(1) Garage sales may be advertised in newspapers or in other media.
(2) A maximum of two signs, not greater in size than two feet by two feet, may be installed on the property where the sale is being conducted. Any such signs shall conform to the requirements of Chapter
470, Zoning, of this Code.
(3) No sign shall be placed on the public right-of-way or upon utility
poles or on property other than where the sale is being conducted.
(4) No lighted signs shall be used.
(5) Any signs to be used for advertisement purposes shall be displayed
only during the hours of sale and shall be removed at the conclusion
of the sale.
G. This article is not intended to change or amend the Chapter
470, Zoning, of this Code.
The provisions of this article shall not apply to or affect
the following persons or sales:
A. Persons selling goods pursuant to an order or process of a court
of competent jurisdiction.
B. Persons acting in accordance with their powers and duties as public
officials.
C. Any sale conducted by any merchant or other business wherein such
sale would be permitted by the zoning laws of the Village or under
the protection of the nonconforming use section thereof or any other sale conducted by a manufacturer, dealer,
or vendor and which sale would be conducted from properly zoned premises
and not otherwise prohibited.
D. Any bona fide charitable, eleemosynary, educational, cultural or
governmental institution or organization; provided, however, that
the burden of establishing the exemption under this subsection shall
be upon the organization or institution claiming such exemption.
