As used in this Part 7, the following terms shall have the meanings
indicated:
BOROUGH OF RARITAN PARKING AREA
The parking lot located to the east side of the Municipal
Building, located at 22 First Street, in the Borough of Raritan, which
is herein designated as a parking area only for police vehicles.
PARK or PARKING
The standing of a vehicle, whether occupied or not, upon
or in the designated parking area otherwise than temporarily for the
purpose of and while actually engaged in receiving or discharging
passengers or in obedience to traffic regulations, signs or signals
or any involuntary stopping of the vehicle by reason of causes beyond
the control of the operator of the vehicle.
PERSON
Includes any individual, firm, copartnership, association
or corporation.
POLICE VEHICLE
Any vehicle which the Borough of Raritan Police Department
owns or leases, whether marked or unmarked, and is used by the Police
Department to effectuate its day-to-day duties within the Borough
of Raritan.
VEHICLE
Any device in, upon or by which any person or property is
or may be transported upon a highway, except a device which is operated
upon rails or tracks. For the purpose of this article, "vehicle" shall
also include any trailer (boat, house, utility, etc.) which can be
towed by any vehicle permitted by the laws of this state.
"Parking area" is defined as the area located to the east side
of the Borough of Raritan Municipal Building, where the entrance to
the Police Department is located, and includes the curbline along
the side of the building which measures approximately 123 feet in
length and also includes the parking area at the far east portion
of the Borough Municipal Building parking lot which has approximately
10 parking spaces and is approximately 97 feet in length, all located
at 22 First Street in the Borough of Raritan, which said site is paved
and constitutes a portion of the parking lot for the Borough of Raritan
Municipal Building.
With the exception of Borough of Raritan police vehicles, it
shall be unlawful and a violation of the provisions of this Part 7
for any person to:
A. Park any vehicle at or on any place in the parking area on the east
side of the Borough of Raritan Municipal Building.
B. Obstruct, impede or interfere with, in any manner whatsoever, the
free and orderly passage of traffic in the parking area of vehicles
parked or reserved for the movement of traffic within or to or from
the parking area.
Any person who shall violate or fail to comply with any of the
provisions of this Part 7 or shall counsel, aid or abate any such
offense or failure to comply shall be deemed guilty of an offense
against the provisions of this Part 7 and shall be punished by a fine
not to exceed $200 or by imprisonment of a term not to exceed 30 days.
Any vehicle which is not immediately removed from the no-parking area
in violation of this Part 7 and is not moved and continues to be parked
in this parking area shall be subject to be removed and towed from
the parking area and impounded, and any and all cost for said towing,
impounding and/or storage thereof shall be the responsibility of the
owner and/or operator of said vehicle. No vehicle shall be returned
to the lawful owner until said costs for towing, impounding and/or
storage thereof is paid in full.
All ordinances and parts of ordinances inconsistent with the
provisions of this Part 7 are hereby repealed; provided, however,
that such repeal shall only be to the extent of such inconsistency,
and in all other respects this Part 7 shall be cumulative of all other
ordinances regulating and governing the subject matter covered by
this Part 7.
If any section or provision or parts thereof of this Part
7 shall be adjudged invalid or unconstitutional, such invalidity or unconstitutionality shall not effect the validity of this Part
7 as a whole or of any other section, provision or part therein.
This entire article shall be deemed and constructed to be an
exercise of the police power of the Borough of Raritan, in the County
of Somerset, for the preservation and the protection of the public
safety so as to keep these parking areas clear of civilian vehicles
so they do not interfere with the patrol vehicles entering and leaving
the designated parking areas so as to allow the patrol vehicles to
respond to any and all emergency calls, and all of its provisions
shall be liberally construed with a view to effectuation of such purpose.
This Part 7 shall take effect immediately upon passage and publication
as required by law.
