No person shall throw, dump or place any garbage, trash, debris
or other waste material on any property which is not owned by or constitutes
the primary residence of such person.
No person shall throw, dump or place any garbage, trash, debris
or other waste material on any property within the Borough for the
purpose or with the intention of having Borough resources pick up
such garbage, trash, debris or other waste material if it has originated
from a location within the Borough of Raritan. It is the intent and
purpose of this provision that persons shall be prohibited from transporting
garbage, trash, debris or other waste material from locations outside
the Borough of Raritan and throwing, dumping or placing such on properties
within the Borough for the purpose or intent of having the Borough
resources pick up and dispose of such garbage, trash, debris or other
waste material. It shall not be a defense to this provision that the
persons violating same may be the owner of a garbage, trash, debris
or other waste material as well as the owner or resident of the property
at which it is being thrown, dumped or placed.
Owners or occupants of property shall not permit or allow any
person to throw, dump or place any garbage, trash, debris or other
waste material upon their property unless this person possesses an
ownership interest in such property or such property constitutes the
primary residence of such person.

Any person violating any of the provisions of this article shall,
upon conviction thereof, pay a fine of not more than $2,000 for each
offense or be imprisoned in the county jail for not more than 90 days
or perform community service for not more than 90 days. Each twenty-four-hour
period that any garbage, trash, debris or other waste material exists
in violation of this article shall constitute a separate and distinct
offense. Any member of the Police Department, Property Maintenance
Office or Public Works Department of the Borough shall be and is hereby
authorized to issue a summons or violation notice upon his or her
belief that probable cause exists for such issuance.
