As used in this Part, the following terms shall have the meanings
indicated:
BUSINESS
Any person, sole proprietorship, partnership, limited liability company, corporation, nonprofit organization or for-profit entity or any other similar entity which pursuant to Chapter
27, Zoning, is designated as a business or home occupation or any such entity which advertises in the general newspaper circulated in McDonald Borough or the telephone or business directories circulated in McDonald Borough. The term "business" or "businesses" shall not include a church, school, municipal related functions such as a volunteer fire department or Authority organized under the laws of the Commonwealth of Pennsylvania, residence, duplex or multifamily residence (except if such residential use includes a separate office for purposes of renting or selling residences).

No business, as defined in this Part, shall conduct any business
in the Borough of McDonald without first having filed a registration/application
with the Borough Secretary in December of each year for the conduct
and the engaging in a business for the subsequent year. Such registration/application
shall provide the name of the business and the address of the business
to include, any address utilized by the business outside of the Borough
of McDonald along with the telephone number and principal contact
person, the nature of the business and the licensing requirements
by Washington or Allegheny Counties, the Commonwealth of Pennsylvania
or the Federal government, as well as the same information regarding
the owner or lessees of the subject property wherein the business
is located.

Upon receipt of a completed registration/application in December
of each year, the Borough Secretary shall, within 14 days of receipt
of the same, issue a business license which shall be valid for the
calendar year next preceding the application. The Borough Secretary
shall solely determine whether or not an application is complete.
Each application shall be accompanied by a check or money order in
an amount to be established, from time to time, by resolution of Borough
Council. For businesses which come into existence in the Borough of
McDonald during the calendar year, the Borough shall pro rate the
business license fee at the rate of $3 reduction for each month a
business is not in existence in McDonald Borough. A business must
make application for a business license prior to the initiating or
commencing business in the Borough or within 30 days of the passage
of this Part for a business existing at the time of enactment of this
Part.

The Borough of McDonald may, from time to time, and by resolution,
revise the information requested on the registration/application form
and may adjust the business license fee.

Any person, business, firm or corporation who shall violate
any provision of this Part shall, upon conviction thereof, be sentenced
to pay a fine of not more than $1,000 plus costs and, in default of
payment of said fine and costs, to a term of imprisonment not to exceed
30 days. Each day that a violation of this Part continues or each
section of this Part which shall be found to have been violated shall
constitute a separate offense. Nothing herein shall be construed to
allow businesses to operate in McDonald Borough which are not otherwise
permitted by law and any such businesses or activities not permitted
by law are prohibited. The Borough Secretary is hereby empowered to
send notices and legal action for enforcement purposes shall be initiated
by the Borough Solicitor.

McDonald Borough reserves the right to request information or
documentation to confirm the information and documentation required
by this Part and may, in addition to imposing the fines and penalties
herein set forth, seek injunctive relief or any other relief in the
Court of Common Pleas of Washington or Allegheny Counties.
