There shall be a Superintendent of Public Works, who shall serve as the principal public works manager as that term is defined in N.J.S.A. 40A:9-154.6a.
The Superintendent of Public Works shall be appointed by the governing body of the Township. The term of office shall commence on the first day of January in each year, or as soon thereafter as the appointment may be made, and shall expire on January 1 next ensuing or on the date of the reorganizational meeting of the governing body, whichever is later.
The Superintendent of Public Works shall be qualified and certified and serve in accordance with the provisions of N.J.S.A. 40A:9-154.6a et seq., and shall among other qualifications hold a commercial driver license (CDL). The Superintendent of Public Works shall be the head of the Department of Public Works, shall be appointed on a full-time basis, and shall devote all his time to the discharge of his duties. He shall be in charge of the Public Works Department with responsibility for the care and maintenance of streets and roads, public buildings and places, municipal motor vehicles, and other public works facilities and equipment. His duties and responsibilities shall be more fully set forth in a job description adopted from time to time by resolution or motion of the governing body.
The compensation of the Superintendent of Public Works shall be as provided in the Salary Ordinance each year.[1]

Pursuant to N.J.S.A. 40A:9-154.6, a person holding the office of Superintendent of Public Works, full time, and who has held such office full time continuously for five years, shall continue to hold such office, notwithstanding its fixed term, during good behavior and efficiency and shall not be removed therefrom for political or other reasons except for good cause, upon written charges filed with the Municipal Clerk and after a public, fair and impartial hearing. However, a person holding such tenure of office may be retired by the governing body when he shall have attained 70 years of age. This § 25-10 may be repealed in the future by action of the governing body, but if such repeal shall occur, it shall not affect tenure already granted pursuant to this section to a holder of the office of Superintendent of Public Works.
