The office of Police Director is hereby established. The Police Director shall be charged with the duties of supervising and establishing the policies for the operation of the Police Department and such other duties and responsibilities as created by this article. The governing body shall constitute the appropriate authority in accordance with N.J.S.A. 40A:14-118.
A. 
Appointment/term. The Police Director shall be annually appointed by the Mayor subject to the advice and consent of the Borough Council and shall serve for the term of one year from the date of appointment. However, it shall be within the discretion of the Mayor and the governing body not to fill this position and to leave the office vacant. In the event that the position of Police Director is vacant, the Chief of Police or the next highest ranking officer of the Police Department shall be the executive head of the Department and perform all of the duties of the Police Director.
B. 
Removal from office.
(1) 
The Police Director may be removed from office for cause, defined as:
(a) 
Failure to perform the duties of Police Director as defined in this article.
(b) 
Mental and/or physical incompetence to perform the duties of the position of Police Director.
(c) 
Conviction of a crime under the laws of the State of New Jersey or a crime or felony under federal law or the law of any other state.
(2) 
If the Police Director is notified that he is to be removed for cause, he may request a public hearing which shall be held not earlier than 15 days nor later than 30 days after his submission of his request to the office of the Mayor. Within five days after the submission of a request for public hearing, the specification of charges shall be supplied to the Police Director. Any hearing shall be convened before the governing body or its designee.
C. 
Salary. The salary of the Police Director shall be as set forth in a Salary Ordinance[1] adopted by the Borough Council as such ordinance shall be amended.

D. 
Powers and duties. The Director of Police shall be charged with the duties of supervising the Police Department and shall be its executive head. The Director of Police shall:
(1) 
Administer and enforce rules and regulations and special emergency directives for the disposition and discipline of the force and its officers and personnel.
(2) 
Prescribe the duties and assignments of all subordinates and other personnel.
(3) 
Delegate such of his authority as he may deem necessary for the efficient operation of the force to be exercised under his direction and supervision.
(4) 
Report at least monthly to the governing body as the appropriate authority in such form as shall be prescribed by such authority on the operation of the force during the preceding month, and make such other reports as may be requested by such authority.
(5) 
Adopt rules and regulations for the Police Department and establish policies for the daily operation of the Police Department and the discipline of its members.
(6) 
With the advice and consent of the governing body, determine the staffing of positions of Lieutenant, Sergeant, Detective Sergeant and Patrol Person, and may choose not to fill said positions as indicated by administrative need.
E. 
Absence. In the absence of the Police Director, the Chief or the next highest ranking officer of the Department on duty shall be in command of the Police Department and shall act for and in the absence of the Police Director unless otherwise indicated by the Police Director.
