A. 
Section 1202(17) of the Borough Code [53 P.S. § 46202(17)] permits the Borough of New Salem to regulate streets and sidewalks and to prohibit obstructions to the convenient use of the same. United States Postal customers are explicitly required by the United States Postal Service Domestic Mail Manual to obey any local regulations concerning the erection of mailboxes. The Borough of New Salem finds that the high volume of traffic along Main and George Streets, the narrow width of the streets, existing on-street parking, and the lack of shoulders or adequate areas for a motorized mail or newspaper delivery vehicle to pull off of the main thoroughfare of the streets during delivery, and the maneuvering of mail or newspaper delivery vehicles between boxes combines to create an unacceptable risk of injury or property damage to mail and newspaper carriers, pedestrians, and the motoring public if mail or newspapers are permitted to be deposited in and collected from curbside mailboxes or newspaper boxes on these streets. New Salem Borough also finds that the residents along Main and George Streets can, with minimal inconvenience, obtain post office box service for mail delivery.
B. 
The purpose of this article is to protect mail carriers, newspaper carriers, pedestrians, motorists, and the general public from personal injury and/or property damage, and the promotion of public good, health, safety and welfare of the residents of New Salem Borough. Nothing in this article shall be construed or interpreted to prohibit mailboxes or newspaper boxes which are affixed to houses or located in front yards to the rear of the interior sidewalk line for any current or future house-to-house walking route delivery by the postal service or newspaper carriers.
A. 
The following words and phrases, when used in this article, shall have the following meanings except where the context or language clearly indicates or requires a different meaning:
BOROUGH
The Borough of New Salem, York County, Pennsylvania.
MAILBOX
Any receptacle which is placed in the sidewalk, grass strip in front of the sidewalk behind the curb, or along the edge of the cartway of a street or road for the receipt of delivery of United States mail.
NEWSPAPER BOX
Any receptacle which is placed in the sidewalk, grass strip in front of the sidewalk behind the curb, or along the edge of the cartway of a street or road for the receipt of delivery of any newspaper.
B. 
In this article the singular shall include the plural, the plural shall include the singular, the masculine shall include the feminine and the neuter gender.
As of the effective date of this article, construction or erection of any mailbox or newspaper box shall be prohibited along the entire length of the following streets within the Borough of New Salem:
A. 
Main Street (north and south).
B. 
George Street (east and west).
Any person who shall violate any provisions of this article shall, upon conviction thereof in a summary proceeding before a Magisterial District Justice, be sentenced to pay a fine of not more than $600 together with costs of prosecution, and in default thereof, to undergo imprisonment in the York County Prison for a period not exceeding 30 days. Each day that a violation continues shall be deemed to be a separate offense and shall be punishable as such.
