The current editions of rules and regulations promulgated by
the Illinois Department of Public Health, pertaining to private sewage
disposal, are hereby adopted by reference. Three copies of each set
shall be on file in the County Clerk's office.
The following definitions shall apply in the interpretation
and enforcement of this chapter:
AGENT
A person or entity that is given permission by the property
owner to act on his/her behalf.
AUTHORIZED REPRESENTATIVE
The Administrator of the Stephenson County Health Department,
and shall include those persons designated by the Administrator to
enforce the provisions of this chapter.
BED-AND-BREAKFAST ESTABLISHMENT
An operator-occupied establishment providing accommodations
for a charge to the public with no more than five guest rooms for
rent, in operation for more than 10 nights in a twelve-month period.
Only breakfast may be provided to the paying guests. Bed-and-breakfast
establishments shall not include motels, hotels, boardinghouses, or
food service establishments.
CONSTRUCTION
The complete installation or replacement of all components
of any new or existing sewage system.
CONVENTIONAL PRIVATE SEWAGE SYSTEM
A private sewer system in which the waste enters a septic
tank that acts as a settling tank for solid waste and then the liquid
and suspended solids travel via gravity or are pumped to subsurface
seepage trenches or beds placed in native, undisturbed soils that
meet specific criteria.
HEALTH DEPARTMENT
The Stephenson County Health Department, its officers, agents
and employees, as the context may require.
HEALTH OFFICER
The Administrator of the County Health Department or any
other duly appointed representative of the County Board of Health.
INSTALL
To construct, reconstruct or modify a private sewage system.
PRIVATE SEWAGE SYSTEM
A system serving a household or business in which all the
components of the system are located on that premises or on adjoining
property where a permanent easement is attached.
PRIVATE SEWAGE SYSTEM INSTALLATION CONTRACTOR'S LICENSE
The annual certificate issued by the Stephenson County Health
Department to qualified private sewage system contractors engaged
in the construction, reconstruction, modification or maintenance of
a private sewage system.
SERVICE
To maintain, clean and/or pump a private sewage system and/or
dispose of private sewage system waste.
SEVERE LIMITATIONS
Soils where characteristics exist within the top five feet
of soil that prohibit the use of a conventional drainfield system.
These limitations are depth to fractured bedrock, soil texture and
depth to water table.
SITE EVALUATION
The physical appraisal of property by an authorized representative
of the Health Department, generally including a soil boring test,
to determine feasibility for a subsurface sewage system.
SOIL INVESTIGATION
The physical appraisal of characteristics of a soil located
on a site for a private sewage disposal system. This shall be accomplished
by the use of soil borings. The soil characteristics shall include,
but not be limited to, identifying type of soil, the limitations of
the soil due to seasonal wetness and depth to bedrock and other pertinent
soil characteristics affecting the performance of a private sewage
system.
