The purpose of this article is to provide for equitable charges
to industrial users based upon quantity and strength of wastewater
discharge in compliance with 18 CFR 601.34, dated July 2, 1970, as
may be amended from time to time.
Rates and charges shall be as established in Chapter
284, Sewer User Fees.

A. Flow meter required. Any industrial or commercial establishment or
facility within the Township of Clark which shall discharge more than
1,000,000 gallons of combined industrial and sanitary waste into the
Clark Township sanitary sewer system shall install and maintain a
flow meter to measure continuously the quantity of flow for the purpose
of determining rates and charges based on actual flow. Further, said
establishment shall monitor loading for total suspended solids (TSS),
biodegradable oxygen demand (BOD), and pH. The flow meter and installation
and the monitoring and maintenance required hereunder shall be installed
at the cost and expense of the property owner and/or operator of the
premises generating the industrial and sanitary waste.
B. Inspections. The Township of Clark, through the Department of Public
Works and Engineering, Division of Engineering, shall have the right
of access to the industrial or commercial user facility during business
hours and upon reasonable notice and shall be provided with access
in order to inspect the flow meter and/or flow records and/or flow
and loading records and/or to take samples for verification and testing.
C. Certification of water usage.
(1) The property owner and/or operator of the industrial premises shall
be required annually to submit a certification of the current year's
water usage. Said certification shall be delivered on or before February
1 of every year for the twelve-month period concluding September 30
of the previous year.
(2) In addition to the foregoing, the property owner and/or operator
shall be required by the date aforesaid to submit accurate records
from the supplying water utility as verification of the annual water
usage to the Township of Clark.
D. Applicability. This section shall be applicable to all industrial
and or commercial users whose combined industrial and sanitary waste
transmissions exceed 1,000,000 gallons of flow per year.
E. Administration fee. All users affected by this section shall pay
to the Township of Clark an administration fee equal to 10% of the
treatment cost for the facility as established by the Rahway Valley
Sewerage Authority. Said sum shall be deemed payable in the same manner
as taxes and, if not paid when due, shall become a lien upon the property.
The annual administration charge shall be billed not later than May
1 and shall be paid not later than July 1 of each year. Any payment
due hereunder shall bear interest to the same extent and in the same
manner as may be charged for any delinquency or late payment of real
estate taxes.
Where the owner provides his/her own water supply, entirely
separate from that supplied by the Township, or provides from its
own sources a portion of the water consumed on the premises which
eventually finds its way into the sewerage system of the Township,
all aforementioned provisions will apply. This does not relieve the
owner from the requirement to furnish, install and maintain a meter
of the indicator-register-record type to measure the discharge of
industrial wastes as provided herein. All costs of furnishing, installing
and maintaining the industrial waste flow meter will be borne by the
owner.
The Township representative shall have access at reasonable
times to industrial establishments and to any meters used to determine
waste volumes discharged into the sewer system or excluded from the
sewer system.
