§ 347-30 Vehicles exceeding weight limits excluded from certain streets.

A. Vehicles over the registered gross weight are hereby excluded from the streets or parts of streets described below, except for the pickup and delivery of materials on such street or the use of emergency vehicles on such street:

B. Exception: limiting the use of streets to certain classes of vehicles.

(1) Except for the pickup and delivery of materials or trucks used by public utility companies in connection with the construction, installation, operation or maintenance of public utility facilities, or trucks used by the Township to provide municipal services, trucks over the gross weight specified are hereby excluded from the streets or parts of streets.

(2) Notwithstanding the provisions of Subsection B(1) above, no deliveries shall be made to commercial buildings and properties on Gibson Boulevard between Brant Avenue and the Garden State Parkway as long as such buildings have access to them for such deliveries from another public street. If, for any reason, a waiver from the prohibition of this subsection becomes necessary as a result of a hardship arising out of the nature of the delivery to be made, a seventy-two-hour notice shall be given to, and permission received from, the Construction Code Official or the Police Department so that full observation of the maneuver of the delivery vehicle can be observed during the time of such delivery. If any damage results from any such maneuver, either to the Township, utility or privately owned property, such property shall be repaired to its full original condition by the owner or operator of the delivery vehicle to the satisfaction of the Construction Code Official or Police Department official observing the maneuver and damage at the time it took place.

[1] Lake Avenue (near side), beginning at the northerly curbline of Lake Avenue and extending 105 feet northerly therefrom.

B. Minimum standards. Below are minimum standards for bus stop length, which are based on recommendations of the Institute of Transportation Engineers and studies conducted by the Bureau of Traffic Engineering and safety programs. These standards include minimum lengths required for bus stops in order that buses may leave moving traffic lanes safely. Keep in mind that buses must stop alongside the curb within six inches thereof as provided by state law pursuant to N.J.S.A. 39:4-135. These minimums are as follows:

(1) Near side: 90 feet, plus the distance from the curbline to the end of the curb return, property line or crosswalk, approximately 105 feet to 120 feet. The minimum acceptable length is 105 feet.

(2) Far side: 85 feet, plus the distance from the curbline to the end of the curb return, property line or crosswalk, approximately 105 feet to 120 feet. The minimum acceptable length is 105 feet.

(3) Midblock, no intersection on either side of roadway: The minimum acceptable length is 135 feet.

(4) Far side (after bus makes right turn): The minimum acceptable length is 140 feet. An additional 45 feet of length should be provided for each additional bus expected to stop simultaneously.

§ 347-40 Taxi stands.

A. The locations described are hereby designated as taxi stands. No vehicle other than a taxi shall be permitted to occupy these locations during the times indicated:

B. Minimum standards.

(1) The minimum length of a taxi stand near an intersection is 25 feet. Adding the sidewalk area of about 10 feet to the area where parking is prohibited by state law would make the starting point approximately 35 feet from the curbline. Other locations should be at least 30 feet for one taxi and 25 feet for each additional taxi.

(2) No taxi stand may be established in any area where it is prohibited to stand or park pursuant to N.J.S.A. 39:4-136.

§ 347-41 Lane use reservations.

The lane locations described are designated as lane use reservations, and traffic shall move as indicated:

§ 347-42 Speed limits.

Speed limits shall be established as follows. Regulatory and warning signs, conforming to the current Manual on Uniform Traffic Control Devices for Streets and Highways, shall be erected and maintained to effect the designated speed limit(s), as required by the Commissioner of Transportation of the State of New Jersey and as specified and authorized in writing from the Bureau of Traffic Engineering of the Department of Transportation.

§ 347-46 Alternate side of street parking.

B. Residential exemption.

(1) Residents of homes referenced on the streets set forth in Subsection A hereof shall be excluded from the force and effect of this section upon their successful application to the Department of Administration of the Township of Clark for a residential exemption, which shall entitle them to park on both sides of the streets set forth in Subsection A without regard to, and irrespective of, the force and effect of this section, and the alternate side of the street parking requirement contained herein shall not be applicable to any resident qualified to receive and receiving such an exemption.

(2) In order to be eligible for a residential exemption, the resident must own the property and reside on one of the streets referenced in Subsection A hereof, or be in possession pursuant to a lawful residential lease, and provide evidence of such residency to the Department of Public Safety of the Township of Clark on the application forms promulgated by said Department. Said application forms shall require the applicant to state the full name and address of the property owner and resident, the make, model and year of the vehicle for which the exemption is applied, the VIN number of the vehicle and the New Jersey automobile license number.

(3) The exemption is not transferable and may not be used at any time by any person or vehicle other than the person or vehicle to whom the exemption was issued. A transfer of said exemption in violation of this provision shall subject the perpetrator to an immediate forfeiture of the exemption for a period of one year and shall be subject to such other penalties as may be provided for herein.

C. Commercial exemptions. Commercial contractors providing services to the residents of homes referenced in Subsection A hereof shall be exempt from the provisions of this section while actively performing such services.

§ 347-46.1 Central Avenue no-obstruction box.

A. No driver shall enter the no-obstruction box in front of the properties on and adjacent to Central Avenue in the westbound direction commonly known as 152 Central Avenue, being Block 71, Lot 2, on the Township's Municipal Tax Map, and commonly known as 136 Central Avenue, being Block 71, Lot 3, on the Township's Municipal Tax Map, unless there is sufficient space on the other side of the no-obstruction box to accommodate the vehicle that such driver is operating without obstructing the ingress to or egress from the driveways on the properties.

B. The no-obstruction box shall be designated as a "don't block the box" area pursuant to N.J.S.A. 39:4-67 and appropriate striping and signage shall be provided.

C. This section is consistent with and amplifies N.J.S.A. 39:4-67, by authorizing appropriate striping and the installation of signage to be designed for this purpose and erected at the no-obstruction box.
