(a) 
It shall be unlawful for any person to sell or expose for sale or cause to be sold or exposed for sale at auction, except under or by virtue of legal process, any goods, wares, merchandise or personal property within the City without having first obtained the proper license as provided in this division.
(b) 
This section shall not apply to judicial sales or sales by executors or administrators or sales under conditional contracts or chattel mortgages or sales by trustees in bankruptcy or to satisfy warehouse liens or by or on behalf of licensed pawnbrokers of unredeemed pledges in the manner provided by law.
(c) 
All auction sales authorized in this article shall be conducted by licensed auctioneers.

An auctioneer's license shall be valid for not less than one day nor more than 30 consecutive days, except Sundays and holidays, for which the licensee shall pay to the City Clerk the sum of $100 per day and furnish the bond required in this division. The license shall authorize the holder, subject to the provisions of this article, New York General Business Law § 21-28 and other ordinances of the City, to sell or offer for sale or cause to be sold or offered for sale at auction any goods, wares, merchandise or personal property within the City.

An auctioneer's license shall be issued by the City Clerk upon compliance with the provisions of this division for the issuance of the license, and upon payment of the license fees required in this division.

Every applicant for an auctioneer's license shall, before the issuance of the license, file with the City Clerk a good and sufficient bond in the sum of $5,000 with a reputable surety company authorized to do business in the state, as surety on the license, conditioned that the license shall not perpetuate, suffer or permit any fraud or imposition to be practiced upon bidders or upon purchasers of property from the auctioneer and that the auctioneer will comply with all the terms and provisions of this article and other ordinances of the City and will render a true and strict account of all sales to the City Clerk. The bond shall be first approved by the Corporation Counsel.

The City Clerk shall revoke any license which may be issued under the provisions of this division for violation of or failure to comply with the terms and provisions of this article by the licensee.
