It shall be unlawful for any person, firm or corporation to
erect or maintain billboards or other similar structures, signs, posters
or display advertising of any kind whatsoever within five hundred
feet of U.S. Route 50 from the bridge at Herring Creek to the corporate
limits of Ocean City, Maryland; provided, however, that nothing herein
shall apply to any such billboard or other similar structure, sign,
poster or display advertising erected and in being on July 1, 1943,
and provided further that nothing herein shall prohibit signs advertising
any lawful business, roadside service or home occupation conducted
upon the premises of an owner of land along said roadway or articles
lawfully manufactured or grown upon such premises by said owner or
signs which advertise the lot or parcel of land on which located as
for sale or to let and which contain no other advertising. Any person,
firm or corporation violating this provision shall be deemed guilty
of a misdemeanor and, upon conviction, shall pay a fine of fifty dollars
for the first offense and a fine of one hundred dollars or thirty
days in jail for the second and subsequent offenses. Each day on which
such violation continues shall be considered a separate offense.
It shall be unlawful for any person, firm, association or corporation
to erect or maintain billboards or other similar structures, signs,
posters or display advertising of any kind whatsoever within five
hundred feet of MD Route 611 commencing from the private road running
easterly from MD Route 611 to the property now or formerly of Thomas
B. McCabe (Map 42, Block 9, Parcel 1, historically known as the Julia
Henry House, c. 1799) south to its intersection with South Point Road
and then continuing south and terminating at the south end of South
Point Road; provided, however, that nothing herein shall apply
to any such billboard or other similar structure, sign, poster or
display advertising erected and in being on June 1, 1957, and provided
further that nothing herein shall prohibit signs advertising any lawful
business, roadside service or home occupation conducted upon the premises
of an owner of land along said roadway or articles lawfully manufactured
or grown upon such premises by said owner or signs which advertise
the lot or parcel of land on which located as for sale or to let and
which contain no other advertising or any community or geographic
region identification sign approved in accordance with the provisions
of § ZS 1-324(g) hereof. Any person, firm, association
or corporation violating this provision shall be deemed guilty of
a misdemeanor and, upon conviction, shall pay a fine of fifty dollars
for the first offense and a fine of one hundred dollars or thirty
days in jail for the second and subsequent offenses. Each day on which
such violation continues shall be considered a separate offense.
