PERSON
Any natural person, partnership, firm or corporation. The
singular shall include the plural and the masculine shall include
the feminine and the neuter.
POOL ROOM and BILLIARD ROOM
Any pool room or billiard room located in the Borough of
Phoenixville, to which the public is admitted, either free of charge
or upon payment of a fee.

No person shall conduct or operate any pool room or billiard
room, unless a license for such operation is obtained from the Chief
of Police and unless the license fee, imposed by this Section, shall
have been paid for the current license period. Such fee shall be in
an amount as established by resolution, from time to time, by the
Borough Council. Such fees shall be for the use of the Borough of
Phoenixville in defraying the expense of licensing and inspecting
such pool rooms or billiard rooms.

No person who shall conduct or operate any pool room or billiard
room shall allow such pool room or billiard room to remain open or
any game of pool or billiards to be played therein at anytime on Sunday;
or on any other day or days between the hours of 11:00 p.m. and 7:00
a.m. of the following day (Daylight Saving Time when in effect).

Every pool room or billiard room shall be conducted in an orderly
manner, and no person conducting or operating such place shall permit
therein any disorderly conduct, gambling, drunkenness or playing of
games for money or any other thing of value.

No person shall knowingly allow or permit any person under the
age of 18 years to be present in any public pool room or billiard
room.

All licenses granted under the provisions of this Part are issued
subject to the rights of the Council of the Borough of Phoenixville
to revoke any said license upon complaint and proof of violation of
the provisions of this Part.

Any person, firm or corporation who shall violate any provision
of this Part shall, upon conviction thereof, be sentenced to pay a
fine of not less than $10 nor more than $1,000 plus costs and, in
default of said fine and costs, to a term of imprisonment not to exceed
30 days. Each day that a violation of this Part continues shall constitute
a separate offense. Provided: such penalty may be imposed against
the holder of a license in addition to the revocation of said license
for the act for which such penalty is imposed.
