A. 
Parking lots, whether publicly or privately owned, may be fully metered, partially metered or make use of any other machine or electronic device to control and regulate parking. As used in this Article VI, a parking meter that serves an individual parking space is referred to as a "single-space parking meter." A parking meter that serves multiple spaces is a "multi-space parking meter."

B. 
The following are designated as the publicly owned metered parking lots in New Hope Borough, subject to the applicable regulations set forth in this chapter:

The owner and/or operator of the private parking lots identified in Subsection C above is responsible for posting all necessary and required signage for the respective parking lot, consistent with all applicable local, county, state and/or federal laws, codes and regulations.

A. 
The following methods are the approved means of payment for use of any off-street parking space in a parking lot that is regulated by a parking meter:
(1) 
Deposit of coin(s) and/or bills (U.S. currency), where applicable, in the meter.
(2) 
Insertion of a valid debit card or credit card in the meter.
B. 
In addition to the payment methods set forth in Subsection A above, any driver or operator of a vehicle may pay for use of an authorized off-street metered parking space regulated by a multispace parking meter by purchasing parking time using a telecommunication device (i.e., phone, computer, mobile device, etc.) through a software application administered by a third-party vendor approved by New Hope Borough. The provisions of § 259-48B and C of this chapter shall apply.

D. 
The day and hours of operation of the parking lot, the time of operation of a parking meter, and the rates for parking in spaces subject to a parking meter will be specified by the Borough Council Parking Resolution.
E. 
The provisions of the Borough Council Parking Resolution related to parking lot hours of operation, times of parking meter operation and the rates for parking in spaces subject to a parking meter will take final effect at a date established in the Parking Resolution. Until the date of final effect, the current parking regulations related to rates and hours of operation (both parking lot and parking meters) will be in force.

A. 
Single-space parking meters installed in the parking lots established by § 259-61 of this chapter shall be placed immediately adjacent to or in close proximity to the individual parking spaces that are marked off and maintained in the parking lot, so as to be visible to vehicle operators. Multispace parking meters shall be installed in accordance with § 259-64 of this chapter.
B. 
For each single-space parking meter there shall be a clear indication, through use of a directional arrow, identification number of the parking space or other similar signage, to show which parking space it serves.
C. 
Each single-space parking meter shall indicate by proper legend the legal parking rate and hours established by New Hope Borough.
D. 
When the adjacent space is occupied by a vehicle:
(1) 
Where payment is made by depositing currency in the meter or by inserting a valid debit or credit card, the single-space parking meter shall indicate on and by its dial, digital indicator and/or pointer the duration of the period of legal parking and, on the expiration of that period, shall indicate illegal parking or overtime parking.
(2) 
For off-street parking lots authorized under this chapter, where payment is made using the software application administered by the approved third-party vendor, the user shall input the number assigned to the off-street parking space to the payment software application and purchase the desired duration of parking time.

A. 
Multispace parking meter kiosks installed in the metered parking lots identified in § 259-61 of this chapter shall be placed at key points in the parking lot with clear signage to indicate their location(s). Payment for spaces in the multispace metered parking lot is required at the multispace parking meter kiosk.
B. 
Where required, the operator of the vehicle is required to enter the license plate information of the vehicle that is parked in the multispace metered parking lot in the multispace meter kiosk, and is to pay in any manner authorized in § 259-48 of this chapter for the amount of time that the operator chooses.
C. 
For parking lots authorized to accept payment through the payment software application, each multispace parking meter kiosk and/or a parking space in such parking lot shall display sufficient information to enable any registered user paying through the payment software application administered by the approved third-party vendor to identify the number assigned to the off-street parking lot and/or individual parking space, as applicable.
D. 
Where a multispace parking meter kiosk issues a temporary parking permit, that permit may be used in any specific or unrestricted parking space in the lot, as applicable, and will indicate by proper legend the parking rate and hours established by the parking resolution adopted by Borough Council for a publicly owned parking lot or the owner/operator of a privately owned parking lot.
(1) 
When the multispace parking meter kiosk dispenses a temporary parking receipt for the date indicating the amount of time requested and paid for, the parking receipt is the temporary parking permit.
(2) 
Such parking permit/receipt shall be prominently displayed by the vehicle operator on the driver's side dashboard and/or the lower left corner of the driver's side windshield of the parked vehicle in a secure manner so that the expiration time of the parking period as shown on the receipt is clearly visible to the parking enforcement officer. Failure to display the parking permit/receipt in this manner shall constitute a separate violation of this chapter.
E. 
Upon the expiration of the time of the parking period allowed for on the parking permit/receipt, or where the multispace parking meter kiosk or approved third-party vendor confirms that the amount of parking time purchased has expired, the vehicle shall be parked in violation of this chapter and may be ticketed per the terms of this chapter.
F. 
Each hour after the date of the initial violation that the vehicle improperly displays the parking permit/receipt or remains in the space after the parking time has expired will be considered a separate violation of this chapter.

A. 
Lines and/or markings shall be painted or placed upon the surface of metered parking lots for the purpose of delineating parking space(s).
B. 
Every vehicle adjacent to any single-space parking meter shall be parked wholly within the lines or markings so placed and applicable to that meter. Every vehicle parking in a lot with multi-space parking meters shall be parked wholly within the lines or markings identifying the parking spaces; and within the specific numbered space if applicable.
C. 
It shall be unlawful and a violation of this chapter for any person:
(1) 
To park a vehicle across any such line or marking; or
(2) 
To park a vehicle in such position that the vehicle shall not be within the area so delineated by the lines or markings, or in the specific space where parking spaces are restricted; or
(3) 
To park a vehicle elsewhere than in an individual parking space, the prohibited areas including, but not limited to, the access and exit driveways and turning and maneuvering spaces.
D. 
In the event that any off-street metered parking lot is leased by the Borough for valet parking, the provisions of this subsection will be waived during the hours of valet parking so long as fire lanes and clear paths for access and exit from the lot are maintained.
It shall be unlawful for any person to park a vehicle in any metered parking lot:
A. 
Otherwise than with the front of the parked vehicle nearest to the parking meter applicable to that space; or
B. 
With any part of the vehicle touching the meter post or head or the raised base or barrier on which meters are erected.

A. 
Whenever a vehicle is to be parked in any parking lot where the parking spaces are regulated by parking meters, whether single-space parking meters, multispace parking meters, or both, at any time when the lot is open for use and parking restrictions and/or parking meters are to be in operation, the operator or driver of the vehicle, upon entering the parking space, shall immediately purchase a desired duration of parking time in a manner approved under § 259-62 of this chapter.
B. 
Upon making the required payment for legal parking time through a method authorized in § 259-62 of this chapter, and placing the parking meter in operation, the parking space may be lawfully occupied by the vehicle for the time indicated on the parking meter or as registered and verifiable through the multispace parking meter kiosk or payment software application administered by the approved third-party vendor, as applicable.

C. 
During the parking meter hours of operation, if any vehicle remains in any parking space for such length of time that the face of single-space parking meter or parking permit/receipt dispensed by the multispace parking meter indicates by proper signal that the lawful parking time has expired where payment is made by direct deposit to the parking meter, or, where the multispace parking meter kiosk or approved third-party vendor confirms that the amount of parking time purchased has expired, that vehicle shall be considered as having been parked overtime, and the parking of a vehicle overtime shall be a violation of this chapter. Each hour that the vehicle remains in the space after the parking time has expired shall be considered a separate violation of this chapter.

A. 
During the hours of parking meter operation, it shall be unlawful, and a violation of this chapter, for any person to permit a vehicle to remain in an off-street parking space in a parking lot identified in § 259-61 of this chapter when:

(1) 
The single-space parking meter displays a signal indicating that the lawful time has expired;
(2) 
For a multispace parking meter parking lot, the information entered in the multispace parking meter kiosk or the displayed parking permit/receipt issued by the meter indicates that the lawful time has expired; and/or
(3) 
The parking time purchased for use of such space through the payment software application has expired.
B. 
Unless authorized under a separate subsection of this chapter, it shall be unlawful, and a violation of this chapter, for any person to permit a vehicle to be in a parking space in any off-street metered parking lot except during the days and hours of operation of the parking lot.
C. 
Vehicles and/or operators of vehicles issued a valid permit for off-street rental parking pursuant to Article VII of this chapter shall be exempt from the hours of operation restrictions of this Article VI, but shall remain subject to all hours of operation restrictions set forth in Article VII of this chapter.

It shall be unlawful, and a violation of this article, for any person to deface, tamper with, open or willfully break, destroy or impair the usefulness of any parking meter installed under the provisions of this chapter. Nothing in this section shall apply to the servicing or opening of parking meters by officers, employees or police officers of the Borough of New Hope under the direction of the Chief of Police.

The parking lots established by this article shall be for the use of passenger cars, passenger vans, sports utility vehicles, motorcycles and pickup trucks only, and it shall be unlawful for any person to park any other type of vehicle in any of those lots.
A. 
It shall be the duty of the police officers and parking enforcement personnel of New Hope Borough, acting in accordance with the directions of the Chief of Police, to report all of the following:

(1) 
The time at which the vehicle occupying a parking space in an off-street metered parking lot established under this chapter is, or has been, parked in violation of this article.
(2) 
The date, hour, location and nature of the violation.
(3) 
The state, provincial and license number of the vehicle in violation.
(4) 
Any other facts, the knowledge of which is necessary for thorough understanding of the circumstances attending the violation.
B. 
The police officer or other person making the report shall also place on or attach to the vehicle a notice to the owner or driver of the vehicle that the vehicle was parked in violation of this article and instructing the owner or driver that if he will report to the office of the Chief of Police and pay, for the use of the Borough of New Hope, the sum specified in Article XII, Fines and Penalties, of this chapter this payment will save the violator from prosecution and from payment of the additional fines and processing fees described in § 259-105 of this chapter.
