The Pottstown Public Library is hereby authorized and designated
to act for and on behalf of the Council of Pottstown Borough to provide
library service to residents and taxpayers of the Borough.

The Council of the Borough of Pottstown hereby agrees to maintain
(or assist in the maintenance of) the Pottstown Public Library in
accord with the provisions of § 401 of the Library Code,
the Act of June 14, 1961, P.L. 324, at a level of financial support
that will insure that the library will have an annual income from
local and State sources of not less than $2.25 cents per capita for
the population of the Borough and will be able to qualify annually
for State financial aid in accord with § 303(1) of The Library
Code.

In accord with § 411 of The Library Code, the Mayor
and Council shall appoint two people to serve as the Borough's
representatives on the Board of Directors of the Pottstown Public
Library, each representative to serve three years, the terms to expire
in different years. Subsequent vacancies are to be filled by people
appointed by the Mayor and Council No person shall be appointed to
serve more than two successive terms.

In accord with § 412 of The Library Code, the Treasurer
of the Board of Directors of the Library shall give bond to the Borough
with satisfactory surety in such amounts as the Board of Directors
of the Library may determine.

In accordance with § 413 of The Library Code, all
monies appropriated for maintenance of the library and all monies,
if any, received from other sources for its use, shall be under the
exclusive control and shall be disbursed under the direction of the
Board of Directors of the library. It shall have all of the rights
and duties delegated to such boards by The Library Code and shall
present a financial report to the Borough annually. Pottstown Borough
shall arrange to have the accounts of the Treasurer of the Board of
Directors audited annually as in the case of other municipal expenditures,
as required by § 413 of The Library Code.

The Board of Directors shall prepare and present a budget for
the following year to the Borough by November 1 of each year and any
other reports as are required by § 414 of The Library Code
and shall give free library service to the residents and taxpayers
of the Borough as provided in § 415 of The Library Code.
