No person shall solicit contributions for any charitable purpose
within the Borough of Bridgeville without a permit from the Mayor
authorizing such solicitation. Provided, the word "charitable," as
used in this Part, shall also include the meanings "philanthropic"
and "patriotic."

An application for a permit to solicit shall be made to the
Mayor at least five days prior to the time at which the permit applied
for shall become effective, such application to be in writing and
to furnish full information as may be required including the name,
address or headquarters of the person applying for the permit, the
purpose for which the solicitation is to be made and the use or distribution
to be made of any receipts therefrom, the name and address of the
person or persons who will be in direct charge of conducting the solicitation
and the time when such solicitation shall be made giving the preferred
dates for the beginning and ending of such solicitation. The Mayor
shall examine all applications filed under this Part and shall make,
or cause to be made, such further investigation of the application
and the applicant as the Mayor shall deem necessary.

The Mayor shall issue a permit provided for in this Part whenever
he shall find:
A. That all of the statements made in the application are true.
B. That the applicant has a good character and reputation for honesty
and integrity.
C. That the control and supervision of the solicitation will be under
responsible and reliable persons.
D. That the applicant has not engaged in any fraudulent transaction
or enterprise.
E. That the solicitation will not be a fraud on the public.
F. That the solicitation was prompted solely by a desire to finance
the charitable purpose described in the application and will not be
conducted primarily for private profit.
G. That the applicant agrees that he/she shall not be permitted to engage
in any business activity, except by prior appointment, at any time
on Sunday, or on any legal holiday, or at any time before 10:00 a.m.
or after dusk on any day of the week other than a Sunday or a legal
holiday.

No charge shall be made for the issuance of the permit under
this Part.

"Solicit" and "solicitation" shall mean the requesting directly,
or indirectly, of money, credit, property, financial assistance or
other thing of value on the plea or representation that such money,
credit, property, financial assistance or other thing of value, will
be used for a charitable purpose and shall include the following methods
of securing same, namely, any oral or written request, the distribution
of hand bills or publications, and the sale of, offer or attempt to
sell any advertisement, advertising space, books, cards, chance, coupon,
device, membership, ticket, subscription or other thing in connection
with which any appeal is made for any charitable purpose, which charitable
purpose shall not include any religious purpose.

Whenever it shall be shown, or whenever the Mayor has knowledge,
that any person to whom a permit has been issued under this Part has
violated any of the provisions of the same, or that any promoter,
agent or solicitor of a permit holder has misrepresented the purpose
of the solicitation, the Mayor shall immediately revoke said permit.

Any person who shall violate any provision of this Part shall,
upon conviction thereof, be sentenced to pay a fine not exceeding
$600 plus costs and, in default of payment thereof, shall be subject
to imprisonment for a term not to exceed 30 days. Each day that a
violation of this Part continues shall constitute a separate offense.
