A certain document is on file in the office of the Code Enforcement Officer of the Town of Bloomsburg, being marked and designated as the "International Property Maintenance Code," 2018 Edition, as published by the International Code Council, and is hereby adopted as the Property Maintenance Code of the Town of Bloomsburg, for regulating and governing the conditions and maintenance of all property, buildings, and structures; by providing the standards for supplied utilities and facilities and other physical things and conditions essential to ensure that structures are safe, sanitary, and fit for occupation and use; and the condemnation of buildings and structures unfit for human occupancy and use, and the demolition of such existing structures as herein provided; providing for the issuance of permits and collection of fees therefor; and each and all of the regulations, provisions, penalties, conditions, and terms of said Property Maintenance Code on file in the office of the Code Enforcement Officer of the Town of Bloomsburg are hereby referred to, adopted, and made a part hereof, as if fully set out in this Part, with the additions, insertions, deletions, and changes, if any, prescribed in § 5-202 of this Part.

The following sections are hereby revised:
A. 
Section 101.1. The following is inserted: The regulations shall be known as the "2018 International Property Maintenance Code of the Town of Bloomsburg" (hereinafter known as the "Code").
B. 
Section 102.3. Application of other codes. Nothing in this Code shall be construed to cancel, modify, or set aside any provision of the Town of Bloomsburg Zoning Ordinance.
C. 
Section 103.5. Insert: The schedule of fees for activities and services performed by the Code Enforcement Officer shall be those fees as established by resolution of Town Council from time to time.
D. 
Section 106.3. Prosecution of violations. Any person failing to comply with a notice of violation or order served in accordance with Section 107 shall be deemed guilty of a summary or civil infraction as determined by the Town of Bloomsburg, and the violation shall be deemed a strict liability offense. If the notice of violation is not complied with, the Code Official shall institute the appropriate proceeding at law or in equity to restrain, correct, or abate such violation, or to require the removal or termination of the unlawful occupancy of the structure in violation of the provisions of this Code or of the order or direction made pursuant thereto. Any action taken by the authority having jurisdiction on such premises shall be charged against the real estate upon which the structure is located and shall be a lien upon such real estate.
E. 
Section 106.4. Violation penalties. Any person who shall violate this Code shall be subject to one of the following enforcement proceedings as determined by the Code Official:
(1) 
A civil enforcement proceeding with fines of not more than $600 for each offense, together with the cost of prosecution; or
(2) 
A summary proceeding with fines of not more than $1,000, or imprisonment for a term not to exceed 30 days, or both, at the discretion of the court.
(3) 
In either type of proceeding, each day that a violation continues after notice has been served shall be deemed a separate offense.
F. 
Section 302.4. Weeds. Weeds or plant growth in excess of six inches in height.
G. 
Section 304.14. Screens. During the period from April 1 to November 1.
H. 
Section 602.3. Heat supply. During the period from September 15 to May 15.
I. 
Section 602.4. Work spaces. During the period from September 15 to May 15.
2. 
Except as amended in § 5-202, the International Property Maintenance Code of 2018 is adopted in its entirety.

The following ordinances shall not be repealed by this Part:
1. 
Ordinance No. 866, enacted September 8, 2003, relating to interconnected smoke detectors.
2. 
Ordinance No. 821, enacted September 13, 1999, relating to occupancy of dwelling units with disabled smoke detectors.
3. 
Ordinance No. 784, enacted March 3, 1996, relating to the use of interior furniture outside of a structure.

If any section, subsection, sentence, clause, or phrase of this Part is, for any reason, held to be unconstitutional, such decision shall not affect the validity of the remaining portions of this Part. The Town Council hereby declares that it would have passed this Part, and each section, subsection, clause, or phrase thereof, irrespective of the fact that any one or more sections, subsections, clauses, and phrases be declared unconstitutional.
