It shall be unlawful for any person, business, real property owner, tenant of leased premises or any individual to establish, maintain and operate a tattoo parlor or a body piercing establishment within 500 feet from any school, day care center, youth recreation center and church or synagogue within the limits of the Borough of Conshohocken.

In addition to the prohibition in § 13-901, above, because of health, safety and general community welfare reasons, the Borough shall not permit the operation of any tattoo parlor or body piercing establishment or business until it has received and approved by way of a permit, a written plan by the owner and/or operator of such establishment detailing particulars as to the method of operation, plans for the storage and removal of refuse, including used needles and human and blood waste products and other pertinent details of the business. The plan shall also specify the safeguards to be utilized to protect the public and especially minors from being coerced or unduly influenced to subscribe to the services provided by the particular establishment.

Any person, firm or corporation who shall violate any provision of this Part shall, upon conviction thereof, be sentenced to pay a fine of not more than $1,000 plus costs and, in default of payment of said fine and costs, to a term of imprisonment not to exceed 30 days. Each day that a violation continues shall constitute a separate offense.

Council may promulgate additional rules and regulations as needed from time to time by resolution in order to further protect the community in areas of health, safety and welfare.
