All shopping carts and other similar carts, provided by the owner for use by others, that are not stored or kept within the limits of the lot on which the owner does business or within the limits of the shopping center in which the owner does business are prohibited. All carts must prominently display the identity of the owner, and will be presumed to be the property of the owner so identified.
A violation of this article shall constitute a municipal infraction. On the first occasion upon which a shopping or similar cart is found outside of the required limits, the City shall give notice of the alleged violation to the owner. Notice may be given in person or by regular mail. For any subsequent violation, the owner of the cart shall be subject to a fine as set out in Chapter 110, Fees and Penalties. In addition to any other remedy allowed by law, the City may remove any shopping carts located outside of the required limits, and may dispose of them in its discretion.
