[HISTORY: Adopted by the Town Council of the Town of Hudson 4-12-1988 as Res. No. R88-15. Amendments noted where applicable.]
The Town of Hudson hereby adopts the provisions of RSA 31:105, "Indemnification for Damages."
The town shall, after this date, indemnify and save harmless for loss or damage from personal financial loss and expense, including reasonable legal fees and costs, if any, arising out of any claim, demand, suit or judgment by reason of negligence or other act resulting in accidental injury to a person or accidental damage to or destruction of property the following persons: all elected or appointed officials and officers of the town including but not limited to members of Board of Selectmen, members of the town's administrative, judicial and advisory boards, commissions and committees, including those boards provided under Town Charter Article X and all other appointive officers provided under Town Charter Article V, and all employees of the town, provided that the indemnified person was acting in the scope of his office or employment at the time of the accident resulting in the injury, damage or destruction and the accident occurred after April 12, 1988.

Editor's Note: Pursuant to Res. No. R92-71, adopted 6-8-1992, effective 7-1-1992, this section has been revised to change "Town Council" to "Board of Selectmen," and "Executive Administrator" has been deleted. Said Res. No. R92-71 also repealed the Charter of the Town of Hudson.
The adoption of this chapter, however, shall not relieve any insurer from its duty of indemnifying and saving harmless from loss the above-named persons under any insurance policy which the town maintains, and the town shall indemnify and save harmless from loss the above-named persons only to the extent not covered by such insurance.
