A. 
All sidewalks shall only be concrete and have a minimum width of four feet, meeting the construction requirements of § 167-39. The width of the sidewalk may be increased to greater than four feet in order to match existing sidewalk widths within that particular block; or to establish a specific desired pattern by the Borough. The determination of sidewalk width shall be only made by the Municipal Construction Official or his or her official designee.
B. 
The location and width of any new or replaced sidewalk shall be such to create an open space between the existing curbline and edge of sidewalk to be known as a governor's strip. The width of sidewalk and the "governor's strip" shall vary from street to street and shall be constructed in accordance with a list on file in the Municipal Construction Code Official's office.
A. 
The purpose of the governor's strip is to provide an open and permeable area within the street right-of-way to encourage both aesthetics and rainwater infiltration. Construction within the governor's strip shall be limited as follows:
(1) 
Within one property width along each street, one concrete access pad to the street of not more than six feet in width.
(2) 
Within one property width along one street, one concrete access pad (driveway apron) in accordance with § 167-22.
(3) 
Vegetation consisting of perennial rye, Kentucky bluegrass, American beachgrass, Avalon salt meadow cordgrass, Atlantic coast panic grass, Sea Isle Japanese sedge, or sea oats. No shrubs, trees, or raised planting beds will be permitted. Irrigation is permitted; however, all lines and heads must be kept at least 12 inches from the back of the existing curb.
(4) 
River rock not less than 3/4 inch in diameter and not more that eight inches in diameter with a finish height not more than two inches above the curb/sidewalk elevation.
(5) 
The sidewalk apron (area between sidewalks and curbing) may be concreted abutting any on-street handicapped parking space designated by the Borough. Where the remaining amount of grass apron is less than 10 feet in length due to the handicapped apron and driveway, the remaining area for that lot width may also be concreted.

(6) 
The sidewalk apron area (governor's strip) along both sides of 22nd Avenue and for the portion of Atlantic Avenue fronted by the corner lots of 22nd Avenue and Atlantic Avenue shall have the existing yellow sidewalk brick reset for the entire width of the lot with the exception of the driveway access and any concrete access pan constructed in accordance with Subsection A(1) above. The yellow sidewalk brick shall be reset in a three-inch mortar base with tight joints and at a cross slope to match that of the sidewalk, assuring positive drainage to the top of the curb and into the street gutter. The longest dimension of the brick shall be constructed perpendicular to the concrete curbing.

B. 
All vegetation shall be maintained to a height not exceeding 36 inches above the existing curb height. No vegetation shall be permitted to extend beyond the face of the curb or into the sidewalk area. No stones less than 3/4 inch in diameter and no rock greater than eight inches in diameter, sand, loose nonvegetative material, or nuisance vegetation will be permitted.
Prior to any work taking place within the street right-of-way, the contractor/property owner shall receive a road opening permit from the Public Works Department. Failure to receive proper permitting prior to installation of new, or replacement of existing, sidewalk and sidewalk apron will result in immediate removal of the work performed.
The property owner shall be responsible for the maintenance of all concrete, stone, and/or vegetation within the governor's strip. The Borough will not be responsible for any damage to irrigation systems within the governor's strip that are damaged due to municipal construction.
A. 
Failure to maintain vegetation within the governor's strip shall constitute a violation of this article. When the Construction Code Official, or his or her designee, determines that the property owner is in violation of all, or part, of this article, a certified letter shall be sent to the property owner directing that said violation be abated within 10 days from the date of said notice. Failure to abate said violation will result in the Borough performing all work to abate said violation and the property owner subject to a lien on his/her property for the Borough's cost of such work.
B. 
Continual persistence in failure to meet the requirements of this article shall result in legal action by the Construction Code Office and subject the property owner, upon conviction, to a fine of not more than $500, or imprisonment in the county jail for not more than 90 days, or both.
