No person, firm, or corporation shall sell, offer, or expose
for sale, any fireworks, toy pistols, or other toy firearms for the
explosion of percussion caps or blank cartridges, without first obtaining
a license as hereinafter provided.
Any person, firm, or corporation may apply to the Town Council
for a license to sell fireworks, toy pistols, and toy firearms, such
application being in writing and containing the full name and address
of the applicant and a description of the premises upon which it is
proposed to sell fireworks, toy pistols, or toy firearms, and such
other information as the Town Council may from time to time designate.
If, in the opinion of the Town Council, the applicant is qualified
to receive a license and the premises where the fireworks are proposed
to be sold will not in their opinion constitute an undue hazard to
others, then the Town Council, upon receipt by them of a fee of $10,
may issue a license permitting the applicant to sell fireworks, toy
pistols, and toy firearms, upon the premises specified in the application,
but not elsewhere.
The Town Council shall keep in a book provided by them the names
and addresses of all such licenses, the date of issue of the license,
and a description of the premises where the fireworks are licensed
to be sold.
The Town Council may revoke the license provided in this chapter
at any time, provided that, if such revocation takes place before
July 1 of the calendar year in which the license is issued, they pay
or tender to the licensee the sum of $10; if revoked on or after July
1, they shall pay or tender to the licensee the sum of $5. The license
issued under this chapter, unless sooner revoked as hereinafter provided,
shall expire at midnight on December 31 of the calendar year in which
it was issued.
Any person selling fireworks, toy pistols, or toy firearms in
the Town of Bedford, without having previously obtained a license
as herein provided, except duly authorized agents or servants of a
licensed person, firm, or corporation, shall be fined not more than
$10 for the first offense and not more than $50 for any subsequent
offense.
