Unless stated in this Part to the contrary or unless the context specifically indicates otherwise, the following terms as used in this Part shall be considered to mean or shall be constituted by the following:
INDUSTRIAL PROPERTY or INDUSTRIAL USER
An industrial, commercial or manufacturing establishment discharging wastes into the sewer system of the Borough of Quakertown which, based upon existing information or experience, or upon periodic analysis, are known or shown to be extra strength wastes and subject to a premium calculated and charged in the manner set forth in Part 3 of this chapter.
PROPERTY
A. 
A building or enclosure occupied as a single dwelling unit or business.
B. 
A combination of buildings in a common enclosure occupied as a single dwelling unit or business.
C. 
One side of double house with a solid vertical partition wall occupied as a single dwelling unit.
D. 
Each dwelling unit or business, in addition to the first dwelling unit or business, occupying the same building or enclosure; provided, however, that where two or more offices are housed in the same building or enclosure, each three offices or fraction thereof shall constitute a single property.
E. 
A business or office combined in the same building or enclosure with a single dwelling unit.

The owner of every property, as defined in § 201, within the Borough limits and connected to the sewer system of the Borough of Quakertown shall pay for those services as follows:
A. 
Minimum Monthly Charges. Charges are based on water consumption. Consumers shall pay the following minimum monthly charges with respect to each property now or in the future served by the water system, which shall be applicable only when the amount of water consumed does not exceed that minimum charge:

C. 
All bills for sewer service shall be rendered monthly for service furnished during the preceding period. The due date for payment of bills shall be 20 days from the date the bill is mailed, except that in the case of the United States Government, the Commonwealth of Pennsylvania or the local municipalities served, or any department or institution thereof, the due date shall be 30 days from the date the bill is mailed. For all customers, a 10% late charge or penalty shall be added after the due date period of 20 days.

In the event that any property subject to the rates established in Subsection 1 of this section is being served by the Borough and shall not have an approved device for measuring the water consumption of that property on or before the effective date of this Part by which the charges established under this section cannot be based upon the metered flow of that water, that property shall be and is hereby levied and assessed a charge based upon an estimate of previous consumption payable in the same manner and at the same time as other rates established under this section. Installation of those water-measuring devices shall render the provisions and rates established under Subsection 1 of this section, operative at the next scheduled billing period following the installation of the device. Charges for properties coming within the provisions of this section whose rates are not covered by Subsection 1 of this section shall be fixed by the Manager with the consent and approval of the Council.

Any water used or water rates charged by the Borough for fire protection shall not be considered in calculating the rates under this section.
4. 
The owner of a property on which is erected a multiple-dwelling unit, occupied by more than one family, including, but not limited to, apartments and flats, is hereby assessed the rate established in Subsection 1 of this section based upon a minimum water consumption of 3,000 gallons for each dwelling unit in that unit per month, or alternatively, the rate established in Subsection 1 of this section based upon the actual water consumption of the entire multiple-dwelling unit, whichever amount is greater.

The Borough of Quakertown will review the user charges at least annually and revise the rates as necessary to ensure that adequate revenues are generated to pay the costs of operation and maintenance, including replacement, and that the system continues to provide for the proportional distribution of operation and maintenance, including replacement costs, among users and user classes.

The Manager shall submit and Council may approve, adopt and promulgate by resolution reasonable rules and regulations to implement and carry out the intent and purposes of this Part. Those rules and regulations may include, but need not necessarily be limited to, the terms and conditions for application for service, rules and regulations concerning the use of the sewer, prohibition against the discharge of certain wastes into the sewer system, reasonable rules and regulations concerning the admission of industrial wastes as well as reasonable remedies and penalties in the event of noncompliance with the rules.

The Borough Council may establish, by resolution from time to time, a fee that all new customers not currently connected into the Quakertown sewage collection system must pay for the privilege of having public sewer service, this fee is to be separate from the connection fee charged by the Borough (as set by resolution of Borough Council) for the Borough's charge to install the lateral to the curbline of the new property being served.
