A. 
No person, association, partnership, firm, or corporation (hereinafter "person") shall, either directly or indirectly, sell goods, wares, merchandise, magazines, periodicals, books, or other personal property by canvassing or soliciting or canvass or solicit for contributions and/or memberships within Londonderry Township without first having obtained a permit from the Township. Application for such permit shall be made on a form provided by the Township.
B. 
A permit shall not be issued to any person who has been convicted of a crime of any kind involving moral turpitude, and such person shall not be allowed to engage in canvassing and soliciting in the Township.
C. 
A permit shall be valid for one year from the date on which it is issued. Such permit may not be transferred from one person to another and shall be considered a personal permit. No more than two permits may be held concurrently by any person. There will be no change of category of goods, services, memberships, etc., sold or solicited during the period of time for which the permit is in effect.
Every person to whom a permit has been issued shall, in the conduct of his/her activity, comply with the following standards of conduct:
A. 
Each person shall carry the permit issued pursuant to § 93-1A at all times and shall exhibit it, upon request, to any state police officer, or Township official or any individual upon whom such person shall call or with whom such person shall talk.
B. 
No person shall permit any person to have possession of the permit, and said person shall immediately report its loss to the Township. No person shall cause or allow the permit to be altered or defaced in any way.
C. 
No person shall enter or attempt to enter any dwelling or otherwise remain upon any private property without the invitation or permission of the occupant or property owner, and said person shall immediately leave any premises upon request of the occupant or property owner.
D. 
Each person shall engage in canvassing or soliciting only between the hours of 9:00 a.m. and 8:30 p.m., Monday through Friday, between 9:00 a.m. and 4:00 p.m. on Saturdays, and between 12:00 noon and 4:00 p.m. on Sundays and legal holidays.
E. 
Every person shall inform the Township, in writing, of any changes to information supplied on the then-current permit application within five days of such change.
F. 
Every person shall immediately surrender the permit upon suspension or revocation thereof.
A. 
A permit may be suspended by the Township if the holder fails to comply with the standards of conduct and responsibilities contained in § 93-2 of this chapter.
B. 
A license may be revoked or suspended upon the basis of fraud, misrepresentation, or the making of knowingly false statements in the application, the application process, or in the course of conducting the permitted operation.
The following persons are exempt from the requirement of this chapter to obtain a permit:
A. 
Political candidates and campaign workers.
B. 
Individuals under the age of 16 years that take orders for and deliver newspapers, greeting cards, candy and the like or that represent the Boy Scouts of America, the Girl Scouts of America, school groups and similar organizations of which they are a member and for which they take orders and deliver cookies and the like.
Public collection (bucket brigades) shall be conducted in accordance with the provisions of § 93-2 of this chapter. Each person participating in the public collection shall identify on his/her body the name of the organization or cause for which the funds are being collected. No public collection shall be permitted on Sunday. Only one nonprofit or charitable organization will be permitted to conduct a public collection on any permitted day or any permitted time period. A nonprofit or charitable organization shall be permitted to conduct a public collection twice per calendar year, provided that each collection is at least six months after the last public collection conducted by such nonprofit or charitable organization.
A. 
Any person who has violated or permitted the violation of the provisions of this chapter shall, upon being found liable therefor in a civil enforcement proceeding commenced by the Township, pay a judgment of not more than $600 plus all court costs, including reasonable attorney fees incurred by the Township as a result thereof. No judgment shall commence or be imposed, levied or payable until the date of the determination of a violation by the Magisterial District Justice. If the defendant neither pays nor timely appeals the judgment, the Township may enforce the judgment pursuant to the applicable rules of civil procedure.
B. 
Each day that a violation continues shall constitute a separate violation, unless the Magisterial District Justice determining that there has been a violation further determines that there was a good-faith basis for the person violating this chapter to have believed that there was no such violation, in which event there shall be deemed to have been only one such violation until the fifth day following the date of the determination of a violation by the Magisterial District Justice. Thereafter, each day that a violation continues shall constitute a separate violation.
C. 
All judgments, costs and reasonable attorney fees collected for the violation of this chapter shall be paid over to the Township.
