The office of Borough Administrator in and for the Borough of
Clayton is hereby created pursuant to N.J.S.A. 40A:9-136 et seq.
A. The
Administrator shall be appointed by the Mayor, with the advice and
consent of the Council, pursuant to N.J.S.A. 40A:60-5.
B. The
Administrator shall serve at the pleasure of the Council, provided
that he may be removed at any time by a 2/3 vote on recommendation
of the Mayor or any Councilperson. The resolution of removal shall
become effective three months after its adoption, unless it is given
immediate effect. In that case, the Council shall cause to be paid
to the Administrator forthwith any unpaid balance of his salary and
his salary for the next three calendar months following adoption of
the resolution.
C. During
the absence or disability of the Administrator, the Mayor shall appoint
an Acting Administrator to perform said duties.
D. On removal or resignation of the Administrator, the Mayor shall appoint an Acting Administrator to serve for 90 days or until an Administrator is appointed pursuant to Subsection
A above, whichever is sooner.
A. The
Administrator shall be paid a salary fixed and adopted by the Council
in the annual Salary Ordinance.

B. Unless
otherwise provided, no Acting Administrator shall be paid more than
his regular salary while serving in that capacity, but he shall be
reimbursed for all necessary expenses incurred in the performance
of his office. If the Council, by resolution, increases the compensation
of the Acting Administrator during his tenure, such increased compensation
shall not exceed the minimum salary provided in the Salary Ordinance
for the position of Administrator.
A. The
Administrator shall be appointed on the basis of his executive and
administrative qualifications. Previous responsible, successful experience
in local government and possession of a master's degree in public
administration, business administration or municipal management shall
be preferred.
B. The
Administrator need not be a resident of the Borough or the state at
the time of his appointment, but may thereafter reside outside the
Borough only with the approval of the Council.
A. The
Administrator shall be the chief administrative officer of the Borough,
responsible to the Mayor and Council for the administration of all
Borough affairs and with the following powers and duties. He shall:
(1) Direct and supervise the administration of all departments, offices
and agencies of the Borough, except as otherwise provided by law.
(2) Recommend to the Mayor and/or the Council appointment and, when necessary
for the good of the service, suspension or removal of department heads
and all other employees, except the Clerk, the Attorney and personnel
appointed by them.
(3) Develop and administer a comprehensive personnel program when approved
by the Council or as provided under civil service pursuant to Title
11 of the New Jersey Statutes Annotated.
(4) Attend all meetings of the Council with the right to take part in
discussion but not to vote.
(5) See that all laws and all acts of the Council subject to enforcement
by him or by officers and employees subject to his direction and supervision
are faithfully executed.
(6) Be responsible for directing and handling the Borough's economic
development and redevelopment initiatives and projects and responsible
for grant writing and coordination on behalf of the Borough.

(7) Submit to the Mayor and Council and make available to the public
a complete report on the finances and administrative activities of
the Borough as of the end of each fiscal year.
(8) Make such other reports as the Mayor and/or Council may require concerning
the operation of Borough government.
(9) Keep the Mayor and Council fully advised as to the current financial
condition and future needs of the Borough and make such recommendations
to them concerning the affairs of the Borough as he deems desirable.
(10) Perform such other duties as may be required by the Mayor and Council.
B. Except
for the purpose of inquiry, the Mayor and the Council and its members
shall deal with the administrative staff only through the Administrator
and shall not give orders or directions to any Borough employee except
through him.

A. There
is hereby created in the Borough of Clayton the office of the Assistant
Borough Administrator, and the title of said office shall be "Assistant
Borough Administrator of the Borough of Clayton."
B. The
Assistant Borough Administrator shall perform the duties of the office
of Borough Administrator in the absence of the Borough Administrator
or upon a vacancy in the office of the Borough Administrator or upon
the disability of the Borough Administrator and shall perform such
other duties and responsibilities as directed by the Borough Administrator.
C. The
Assistant Borough Administrator may continue to hold and perform the
duties of another Borough office.
D. The Assistant Borough Administrator shall be appointed by the Mayor with the advice and consent of the Council and shall be subject to all other applicable provisions of Chapter
2 of the Code of the Borough of Clayton.
E. Any
salary to be paid to the Assistant Borough Administrator shall be
fixed in the annual Salary Ordinance. He/she will be reimbursed for necessary expenses incurred
in the performance of the office.
F. The
Assistant Borough Administrator shall be appointed on the basis of
his/her executive and administrative qualifications.
G. The
Assistant Borough Administrator need not be a resident of the Borough
of Clayton.
