The Board of Supervisors of the Township of Kingston, by and through
its authority and relationship with the aforementioned volunteer fire
companies and rescue company[1] hereby grants the authority and authorizes the volunteer
fire companies and the rescue company to recover the reasonable costs
of fire fighting materials, equipment, personnel hours and hazardous
abatement materials involving any hazardous material incident, or
fire, or safety and rescue incident or operation including, but not
limited to, vehicular accidents.

Editor's Note: The Township of Kingston has recognized and
designated the Trucksville Volunteer Fire Company and Shavertown Volunteer
Fire Company (hereinafter referred to as "volunteer fire companies"),
and the Kingston Ambulance Association (hereinafter referred to as
"rescue company").

Said reasonable costs as referred to above may be recovered directly
by the volunteer fire companies and rescue company(s), which are recognized
and designated by the Township of Kingston, through the Township,
with the consent of the Township Manager, or through a third party
billing service designated as an authorized agent for the collections
of said reasonable costs by the volunteer fire companies and rescue
company(s); from time to time. The utilization of PA Fire Recovery
Service shall be for those situations deemed by PA Fire Recovery Service
as appropriate for collections through the Agency, principally those
incidents involving the use of hazardous abatement materials and/or
rescue incidents directly involving the Luzerne County Emergency Management
Agency.

In addition to the aforementioned reasonable costs, the volunteer
fire companies or the rescue company(s) or PA Fire Recovery Service
shall be authorized to collect reasonable interest, as well as a reasonable
administrative fee for collecting the same, and any and all additional
fees as may be authorized by the Hazardous Material and Emergency
Planning and Response Act, or authorized by any other statute, case
law or common law.
