This Part 1 shall be known and may be cited as the "Swimming Pools, Spas and Hot Tubs Ordinance of the Borough of Quakertown."

For the purposes of this Part 1, the following terms, phrases, words and their derivations shall have the meanings given in this section. When not inconsistent with the context, words used in the present tense include the future, and the word "shall" is always mandatory and not directory.
ABOVEGROUND/ON-GROUND POOL
See "swimming pool."
BARRIER
A fence, wall, building wall or combination thereof which completely surrounds the swimming pool and obstructs access to the swimming pool.
HOT TUB
See "swimming pool."
IN-GROUND POOL
See "swimming pool."
RESIDENTIAL
That which is situated on the premises of a detached one- or two-family dwelling or a one-family townhouse not more than three stories in height.
SPA, NONPORTABLE
See "swimming pool."
SPA, PORTABLE
A nonpermanent structure intended for recreational bathing, in which all controls and water-heating and water-circulating equipment are an integral part of the product.
SWIMMING POOL
Any structure intended for swimming or recreational bathing that contains water over 24 inches (610 mm) deep. This includes in-ground, aboveground and on-ground swimming pools, hot tubs and spas.
SWIMMING POOL, INDOOR
Any swimming pool which is totally contained within a structure and surrounded on all four sides by the walls of the enclosing structure.
SWIMMING POOL, OUTDOOR
Any swimming pool which is not an indoor pool.

Before work is commenced on the construction of a swimming pool or family pool or on any alteration, addition, remodeling or other improvement to a swimming pool or family pool, an application for a permit to construct and the plans and specifications and pertinent explanatory data shall be submitted to the Building Inspector for his approval; and no part of the work shall be commenced until he has granted approval by a written permit to construct and has further evidenced his approval by a suitable endorsement upon the plans and specifications.

Plans, specifications and pertinent explanatory data required to be submitted in connection with an application for a permit to construct a swimming pool or any alteration, addition, remodeling or other improvement to a swimming pool shall comply with the requirements of this Part 1 and shall include such other data as may be reasonably requested by the Building Inspector.

The buildings, grounds, dressing rooms and all other swimming pool or family pool facilities shall be kept clean and in a sanitary condition and maintained free from garbage, trash and other refuse.

The Building Inspector shall inspect or cause to be inspected all swimming pools and family pools within the Borough at those times as he may deem necessary to carry out the intent of this Part 3. The Building Inspector is hereby authorized to enter upon any premises, private or public, to take such samples of water from any pool at those times as he may deem necessary and to require the owner, proprietor or operator to comply with rules and regulations pertaining to swimming pools promulgated by the Building Inspector in accordance with this Part. In the event of the failure of compliance, after due notice, with the rules and regulations and requirements of the Building Inspector or the requirements of this Part1, the Building Inspector shall have the power to abate or cause a suspension of the use of the swimming pool or family pool concerned until the pool is, in the opinion of the Building Inspector, no longer a menace or a hazard to health or safety.

No swimming pool or family pool shall be so located, designed, operated or maintained as to interfere unduly with the enjoyment of the property rights by owners of property adjoining the swimming pool or family pool or located in the neighborhood, nor shall any part of any such pool be located less than six feet from any rear or side property line or 10 feet from any street property line.

The fee for a permit to construct a new swimming pool or to construct any additions, improvements or alterations or for the remodeling of an existing swimming pool shall be the same as that charged for building permits.

Any person who shall violate any provision of this Part 1 shall, upon conviction thereof, be sentenced to pay a fine not exceeding $600 and costs and, in default of payment thereof, shall be subject to imprisonment for a term not to exceed 30 days. Each day that a violation of this Part continues shall constitute a separate offense.
