In a Marine Residence District, buildings and structures may be erected, altered or used and lots or premises may be used in accordance with the provisions of this article.
A building or structure may be erected, altered or used and a lot or premises may be used for the following purposes, and no other:
A. 
Any use permitted by this ordinance in a B Residence District.
B. 
Private membership, nonprofit yacht or boating clubs.
A. 
No residential building or any building or structure accessory thereto may be erected, altered or used and no lot or premises may be used for residential purposes, except in compliance with the height, building area, front yard, side yard, rear yard, permitted encroachments, fences, accessory buildings and density of population regulations specified in Article VII of this ordinance.
B. 
No building or structure may be erected, altered or used and no lot or premises may be used for a private membership, nonprofit yacht or boating club, except in conformity with the following regulations:
(1) 
No building or structure may be erected, altered or used except on a lot having an area of 15,000 square feet or more and a frontage both on a public highway and waterway, each of 150 feet.
(2) 
No building or structure shall be erected, altered or used which has more than two stories or which is more than 35 feet in height.
(3) 
Each improved plot shall have a front yard and back yard, each of not less than 25 feet, and side yards each of not less than 10 feet.
(4) 
Notwithstanding any other provision of this ordinance, each club may have one sign not larger than eight square feet bearing only the club name.
(5) 
No access driveway to any parking area shall be nearer than 50 feet to any premises zoned for residential use.
(6) 
The accessory parking regulations specified in § 319 of this ordinance shall be complied with.
C. 
No building or structure for other than residential or club purposes may be erected, altered or used and no lot or premises may be used for other than residential or club purposes, except in compliance with the height, building area, front yard, rear yard and density of population regulations specified in Article XVI of this ordinance, and with the necessary parking regulations specified in § 319 of this ordinance.
D. 
A structure shall not be constructed over, into or in any waterway of the Town of Hempstead unless and until there is compliance with the provisions of Chapter 168 of the Code of the Town of Hempstead relating to structures in waterways.
