In a Marine Commercial District, buildings and structures may
be erected, altered or used and lots or premises may be used in accordance
with the provisions of this article.
A building or structure may be erected, altered or used and
a lot or premises may be used for the following purposes, and no other:
A.
Any use permitted by this ordinance in a Marine Residence District,
except dwellings.
B.
Yards and marinas, including wet and dry storage, for construction
of and repairs to boats of not more than 20 tons and not more than
85 feet in length.
C.
Fishing stations.
E.
Stores for the display and sale of marine equipment and supplies.
F.
Gas filling station for boats when approved as an exception by the
Town Board; provided, however, that if a station approved pursuant
to this subsection is not in operation within six months from the
date of the approving resolution, the permit therefor may be revoked
by the Town Board in its discretion.
A.
No building or structure may be erected, altered or used and no lot or premises may be used except in compliance with the height, building area, front yard, rear yard and density of population regulations specified in Article XVI of this ordinance and with the accessory parking regulations specified in § 319 of this ordinance.
B.
As used in this article. the word "restaurant" shall include only
facilities for the preparation of food and drink for consumption on
the premises by patrons seated at tables or counters, conducted entirely
indoors in and on the ground level of the building to which such facilities
are accessory, occupying not more than 50% of the ground level area
of such building, every entrance to which, except to the kitchen,
shall be from another room of such building.
C.
A structure shall not be constructed over, into or in any waterway
of the Town of Hempstead unless and until there is compliance with
the provisions of Chapter 168 of the Code of the Town of Hempstead
relating to structures in waterways.
