In the construction of this Code and of all ordinances of the City, the following definitions and rules of construction shall be observed, unless they are inconsistent with the manifest intent of the Board of Aldermen or the context clearly requires otherwise:
Generally. The provisions of this Code shall be liberally construed to effect the purposes expressed therein or implied from the expression thereof. In case of doubt or ambiguity in the meaning of such provisions, the general shall yield to the particular. Reference for interpretation and construction shall tend to further the accomplishment of the elimination of the particular mischiefs for which the provisions were enacted. Words shall be construed in their common and usual significance unless the contrary is clearly indicated. In the interpretation and application of any provision of this Code, it shall be held to be the minimum requirements adopted for the promotion of the public health, safety, comfort, convenience and general welfare. Where any provision of the Code imposes greater restrictions upon the subject matter than other more general provisions imposed by the Code, the provision imposing the greater restriction or regulation shall be deemed to be controlling.
BOARDWhenever the word "board" is used, unless otherwise specified, it shall be construed to mean the Board of Aldermen of the City of Milford, Connecticut.
CHARTERThe word "Charter" shall mean the Charter of the City of Milford, Connecticut, specifically, Special Act No. 139 of 1959, as amended.
CITYThe words "the City" or "this City" shall mean the City of Milford in the County of New Haven, in the State of Connecticut.
COMPUTATION OF TIMEThe time within which an act is to be done shall be computed by excluding the first and including the last day; and if the last day be Sunday or a legal holiday, that day shall be excluded.
COUNTYThe words "the county" or "this county" shall mean the County of New Haven in the State of Connecticut.
GENDERA word importing the masculine gender only shall extend and be applied to females and to firms, partnerships and corporations as well as to males.
GENERAL STATUTESThe words "General Statutes" shall mean the revision of 1958 of the General Statutes of the State of Connecticut and all amendments thereto.
JOINT AUTHORITYAll words giving a joint authority to three or more persons or officers shall be construed as giving such authority to a majority of such persons or officers unless otherwise specifically provided.
KEEPER, PROPRIETORThe words "keeper" and "proprietor" shall mean and include persons, firms, associations, corporations, clubs and partnerships, whether acting by themselves or through a servant, agent or employee.
MAYThe word "may" is permissive.
MAYORWhenever the word "Mayor" is used, it shall mean the Mayor of the City of Milford, Connecticut.
MONTHThe word "month" shall mean a calendar month.
NAME OF OFFICERWhenever the name of an officer is given, it shall be construed as though the words "of the City of Milford" were added.
NONTECHNICAL AND TECHNICAL WORDSWords and phrases shall be construed according to the common and approved usage of the language; but technical words and phrases and such others as may have acquired a peculiar and appropriate meaning in law shall be construed and understood according to such meaning.
NUMBERA word importing the singular number only may extend and be applied to several persons or things, and a word importing the plural number may apply to one person or thing.
OATHThe word "oath" shall include an affirmation in all cases in which by law an affirmation may be substituted for an oath, and in such cases the words "swear" and "sworn" shall be equivalent to the words "affirm" and "affirmed."
OR, ANDIf the sense requires it, "or" may be read "and"; "and" may be read "or."
OWNERThe word "owner," applied to a building or land, shall include any part owner, joint owner, tenant in common, tenant in partnership or joint tenant of the whole or of a part of such building or land.
PERSONThe word "person" shall extend and be applied to associations, firms, partnerships and bodies politic and corporate as well as to individuals.
PERSONAL PROPERTYThe term "personal property" shall include every species of property except real property, as herein described.
PRECEDING, FOLLOWINGThe words "preceding" and "following" shall mean next before and next after, respectively.
PREMISESWhenever the word "premises" is used, it shall mean place or places.
PROPERTYThe word "property" shall include real and personal property.
REAL PROPERTYThe term "real property" shall include lands, tenements and hereditaments.
SEALWhenever the word "seal" is used, it shall mean the City or Corporate Seal.
SHALLThe word "shall" is mandatory.
SIDEWALKThat area within any street which is designed for the pedestrian travel of the public, and shall also include any area along and parallel to any street between the building line and the street line of such street which is paved as a sidewalk for the pedestrian travel of the public.
STATEThe word "state" shall mean the State of Connecticut.
STREETThe word "street" shall include avenues, boulevards, highways, roads, alleys, lanes, viaducts, bridges and the approaches thereto, and all other public thoroughfares in the City and shall mean all that part thereof from the property line of the premises abutting thereon.
TENANT, OCCUPANTThe words "tenant" and "occupant," applied to a building or land, shall mean any person who occupies the whole or a part of such building or land, whether alone or with others.
TENSEWords used in the past or present tense include the future as well as the past and present.
WEEKThe word "week" shall be construed to mean seven days.
WRITTEN, IN WRITINGThe term "written" or "in writing" shall include any representation of words, letters or figures, whether by printing or otherwise.
YEARThe word "year" shall mean a calendar year, unless otherwise stated.
