The entire City is hereby constituted as a sanitation district for the collection and disposal of ashes, garbage and other refuse matter.

As used in this chapter, the following terms shall have the meanings indicated:
A dumpster weighing more than 25 pounds when empty.
The City of Milford.
Any printed or written matter, any sample or device, dodger, circular, leaflet, pamphlet, paper, booklet, or any other printed or otherwise reproduced original or copies of any matter of literature, excluding newspapers:
Which advertises for sale any merchandise, product, commodity or thing; or
Which directs attention to any business or mercantile or commercial establishment or other activity for the purpose of either directly or indirectly promoting the interest thereof by sales; or
Which directs attention to or advertises any meeting, theatrical performance, exhibition or event of any kind, for which an admission fee is charged for the purpose of private gain or profit; but the terms of this subsection shall not apply where an admission fee is charged or a collection is taken up for the purpose of defraying the expenses incident to such meeting, theatrical performance, exhibition or event of any kind, when any of the same is held, given or takes place in connection with the dissemination of information which is not restricted under the ordinary rules of decency, good morals, public peace, safety and good order; provided, that nothing contained in this subsection shall be deemed to authorize the holding, giving or taking place of any meeting, theatrical performance, exhibition of any kind, without a license, where such license is or may be required by any law of this state, or under any ordinance of this City; or
Which, while containing reading matter other than advertising matter, is predominantly and essentially an advertisement, and is distributed or circulated for advertising purposes, or for the private benefit and gain of any person so engaged as advertiser or distributor.
Metal or plastic receptacle intended to contain or store litter.
Garbage, refuse, rubbish and trash, and all other material which if thrown, deposited or stored as herein prohibited, tends to create an unsightly condition, a public nuisance, or danger to public health, safety or welfare.
Any printed or written matter, any sample or device, dodger, circular, leaflet, pamphlet, newspaper, magazine, paper, booklet or any other printed or otherwise reproduced original or copies of any matter of literature not included in the aforesaid definitions of a commercial handbill or newspaper.
Any person, firm, partnership, association, corporation, company or organization of any kind.
Any street, sidewalk, alley or other public way, and any and all public parks, squares, spaces, grounds, beaches, and buildings.
Every device in, upon or by which any person or property is or may be transported or drawn upon a highway, including devices used exclusively upon stationary retails or tracks.

No person shall throw or deposit litter in or upon any street, sidewalk or other public place within the City except in public receptacles or in authorized private receptacles for collection; provided, however, that said public receptacles shall not be used for the deposit of domestic or commercial litter arising from the conduct of activities on such property.

No person shall sweep into or deposit in any street, sidewalk, gutter, park or other public place within the City any litter or the accumulation of litter from any building or lot or from any public or private sidewalk or driveway and cause same to remain for an unreasonable period of time.

No person shall throw or deposit litter in any fountain, pond, stream or other body of water in a park or elsewhere within the City.

Persons owning or occupying property shall keep the sidewalk in front of their premises free of litter.

No person while a driver or passenger in a vehicle shall throw or deposit litter upon any street or other public place within the City.

No person shall drive or move any truck or other vehicle within the City unless such vehicle is so constructed or covered as to prevent any load or contents of litter from being blown or deposited upon any street or other public place.

(a)
It shall be unlawful for any person owning, keeping, walking or in control of any dog to allow or permit such animal to defecate upon any private property, owned by another person, or condominium common elements or public property, including but not limited to public beaches, parks and school grounds, unless such person shall remove all feces so deposited by such animal and dispose of same in a proper manner before leaving the immediate premises.

The provisions of this section shall not apply to a guide dog accompanying any blind person.

Non-municipally owned garbage cans and bulk refuse containers containing nondemolition waste shall be kept and maintained in a covered condition so as to prevent any contents from escaping. It is both the owner's and occupant's responsibility to properly maintain the covered condition set forth hereunder.

(a)
Throwing or distributing commercial handbills prohibited in public places. No person shall throw or deposit any commercial or noncommercial handbill in or upon any sidewalk, street or other public place within the City; nor shall any person hand out or distribute or sell any commercial handbill in any public place except as provided below; provided, however, that it is not unlawful on any sidewalk, street or other public place within the City for any person to hand out or distribute, without charge to the receiver thereof, any commercial or noncommercial handbill to any person willing to accept it.
(b)
Prohibiting placing commercial and noncommercial handbills on vehicles. No person shall throw or deposit any commercial or noncommercial handbill in or upon any automobile or other vehicle; provided, however, that it is not unlawful in any public place for a person to hand out or distribute, without charge to the receiver thereof, a noncommercial handbill to any occupant of a vehicle who is willing to accept it.
(c)
Prohibiting distribution of handbills where properly posted or vacant. No person shall throw or deposit any commercial or noncommercial handbill in or upon any private residence or other private property which are known or reasonably should be known to be temporarily or continuously uninhabited or vacant.
(d)
Prohibiting distribution of handbills where properly posted. No person shall throw, deposit or distribute any commercial or noncommercial handbill upon any private residence or other private property, if requested by anyone thereon not to do so, or if there is placed on the residence or property, in a conspicuous position near the entrance thereof, a sign bearing the words "No Trespassing," "No Peddlers or Agents," "No Advertisement," or any similar notice indicating in any manner that the occupants of the residence or property do not desire to be molested or have their right of privacy disturbed, or to have any such handbills left upon such premises.
(e)
Manner of distributing commercial and noncommercial handbills at inhabited private residences.
(1)
No person shall throw, deposit, or distribute any commercial or noncommercial handbill in or upon any private residence, which is inhabited, except by handing or transmitting any such handbill directly to the owner, occupant or other person then present in or upon such private residence; provided, however, that in case of any inhabited private residence which is not posted, as provided in this chapter, such person, unless requested by anyone upon such residence not to do so, may place or deposit any such handbill in or upon such inhabited private residence, if such handbill is so placed or deposited as to secure or prevent such handbill from being blown or drifted about such residence or sidewalks, streets or other public places, and except that mailboxes may not be so used when so prohibited by federal postal law or regulations.

Exemption for mail and newspapers. The provisions of this section shall not apply to the distribution of mail by the United States, nor to newspapers.

(a)
Police officers or their designees may issue a citation for any violations of the provisions of this chapter. Persons receiving said citations shall be deemed to have committed an infraction and shall be fined in accordance with Connecticut law, the maximum penalty for infractions.
(b)
Each violation that is committed or that is permitted to continue shall constitute a separate offense and shall be cited and punished as such.
(c)
In addition to any monetary fine imposed hereunder, any person who violates any provision of this chapter may be required to remove or otherwise cure the violation, and may, in lieu of citation for infraction, be prosecuted pursuant to the provisions of Gen. Stat. § 22a-250, as same may be amended from time to time.
