ARTICLE II STOPPING, STANDING AND PARKING

The parking area adjacent to Gulf Beach or Walnut Beach or any other area designated by the Milford Police Department may be divided into a restricted area and an unrestricted area to be clearly marked and designated by appropriate signs. No person shall park a vehicle in any restricted area unless such vehicle shall have visibly displayed on the lower right-hand (passenger side) corner of the rear windshield or passenger side rear bumper, a sticker for the current year certifying that the owner is a resident or taxpayer of the City. Notwithstanding the foregoing, the board of Police Commissioners may designate up to eight parking spaces within the restricted area at Gulf Beach which do not require a sticker but which are subject to a thirty- minute time limit restriction.

Parking stickers may be obtained either in person or by mail from the City of Milford Tax Office upon proof that the registered owner of the vehicle is either a resident or a taxpayer of the City. Stickers may be obtained free of charge by eligible residents and taxpayers from the City of Milford Tax Collector's Office commencing August 15, 2005. All mail-in applications must be accompanied by a photocopy of a current, valid motor vehicle registration and one or more of the following as may be applicable pursuant to Section 14-12(c) below:

A lease or sworn affidavit from a landlord;

A copy of a City of Milford tax bill issued to an association, corporation, business or individual owning commercial real estate or personal property in the City of Milford.

Replacement of any sticker obtained on and after August 15, 2005, may be had for a fee of $25 accompanied by an affidavit of lost, stolen or destroyed sticker. Replacement stickers shall be provided free of charge to any eligible person who transfers his registration to a new vehicle or has a rear windshield or rear bumper replaced and provides satisfactory proof thereof.

All stickers shall be valid for one year periods commencing January 1, 2006, and expiring December 31 in each year thereafter. Any sticker presently in use shall expire December 31, 2005.

For the purposes of this section, an eligible resident or taxpayer is defined as follows and must present a current, valid motor vehicle registration to obtain a parking sticker.

Any resident [as defined in Subsections (2), (3), and (4) below] or taxpayer of the City of Milford.

Any year-round tenant (lease must read 12 months or more) occupying a dwelling in the City of Milford, upon submission of a lease or sworn affidavit from the landlord.

Any summer tenant renting a house or lodging in the City of Milford for one month or more after presentation of a motor vehicle registration and lease, or sworn affidavit from the landlord.

Any association, corporation, business or individual owning commercial real estate or personal property in the City of Milford, and paying property taxes thereon, is entitled to have one individual designated as eligible to obtain a parking sticker.

General prohibitions.

Parking stickers are nontransferable.

Obtaining or attempting to obtain a sticker under false pretenses.

Aiding an ineligible person in an attempt to obtain a sticker.

No sticker shall be issued to any person who has unpaid taxes.

Displaying or aiding in the display of any sticker obtained in violation of the lawful procedures contained herein.

Sec. 14-13 Beach and other restricted parking areas — Parking charges for unrestricted area during certain months of the year; seasonal parking sticker.

Penalties. Any person who violates, or assists another in violating any of the provisions of this section shall be deemed to have committed an infraction and in addition, shall forfeit the right to a sticker and attendant parking privileges for a period of two years. Such persons shall immediately remove the sticker from their vehicle. In addition to any other remedies, the City may institute an action for injunctive and other judicial relief to enforce the provisions of this section.

From May 1 to and including September 30 of each year during beach hours as set forth in Section 16-2, no person shall park a motor vehicle in the parking areas at Gulf Beach or Walnut Beach marked and designated by appropriate signs as an unrestricted area without paying a parking charge of $40 per day or any portion thereof at the nearest kiosk, unless said vehicle displays a sticker as provided in Section 14-12 or 14-13(c).

From May 1 to and including September 30 of each year during beach hours as set forth in Section 16-2, no person shall park a motor vehicle in a numerically designated street parking space in the Walnut Beach area without paying a parking charge of $5 per hour or any portion thereof at the nearest kiosk, unless said vehicle displays a sticker as provided in Section 14-12 or 14-13(c).

Any person may purchase a seasonal parking sticker in lieu of paying the daily parking charge upon the payment of $250. Such sticker will permit parking in the unrestricted area for the period of May 1 to and including September 30 of each year. Such sticker shall be issued by the Recreation Department and shall be visibly displayed on the lower right-hand (passenger side) corner of the rear windshield or passenger side rear bumper.

Sec. 14-14 Alternate-side snow parking; Driveway parking; Deposit of snow and ice; Penalties for violation.

Any motor vehicle parked in violation of this section may be towed pursuant to Section 14-24 of this article. Additionally, vehicles parked in violation of this section may be fined $85 for each violation. Each hour parked shall constitute a new violation.

Alternate-side-of-the-street-snow-parking. During any period of snow and/or ice where conditions require that residential streets be plowed, alternate-side-of-the-street parking shall automatically take effect on all City streets where parking is otherwise permitted on both sides of the street without further notice. Alternate-side-of-the-street parking shall mean that parking will be allowed on the odd-numbered side of the street (i.e., side of the street having odd-numbered street addresses) on odd-numbered days of the month, from 8:00 a.m. on the day thereof until 8:00 a.m. on the following day, and on the even-numbered side of the street (i.e. on the side of the street having even-numbered street addresses) on even-numbered days of the month, from 8:00 a.m. on the day thereof until 8:00 a.m. on the following day. Parking is prohibited on the side of the street where it is not expressly permitted hereunder.

Example: If it snows on December 1, on-street parking shall be permitted on the odd side of the street from 8:00 a.m. on December 1 until 8:00 a.m. on December 2. Parking is prohibited on the even side of the street from 8:00 a.m. on December 1 until 8:00 a.m. on December 2.

Penalty and vehicles subject to towing. Any vehicle which is found to be parked on a side of the street other than the side designated for that date during a snowstorm, may be issued a parking ticket in the amount of $25 and removed by towing at the direction of the Milford Police Department.

Impoundment of vehicle. Such motor vehicle, having been so removed, shall continue to be impounded until the towing and storage charges, shall have been paid by the owner or person entitled to possession of such vehicle.

Parking in driveway. No person having access to a driveway shall permit a motor vehicle owned by him or any member of his household to remain parked on an adjoining public street during such weather conditions requiring that residential streets be plowed. Police officers may issue a citation for any violations of the provisions of this section. Persons receiving said citations shall be deemed to have committed an infraction and shall be fined $25.

Sec. 14-15 Parking of trailers, semitruck trailers, boats, campers, camp trailers, motor homes, commercial vehicles, recreational vehicles and nonmotorized vehicles; penalties for violation. [1]

Snow or ice deposits. No person shall cause snow or ice to be deposited on any public street or sidewalk within the City of Milford. Police officers may issue a citation for any violations of the provisions of this section. Persons receiving said citations shall be deemed to have committed an infraction and shall be fined $25.

No trailer, semitruck trailer, boat, camper, camp trailer, motor home, commercial vehicle, recreational vehicle or nonmotorized vehicle, or other trailer for such vehicle or vehicles, whether or not such vehicle is on the trailer or attached to a motorized vehicle, shall be parked or stored or allowed to stand upon a street or highway or upon land areas devoted by the traffic commission of the City or within the limits of a City or state right-of-way unless the trailer or vehicle is temporarily disabled for a period not to exceed 24 hours while so disabled.

This section shall not apply to the parking or standing of commercial vehicles between the hours of 7:00 a.m. and 6:00 p.m. for the purpose of making pickups or deliveries from or to any home, structure, or building, or for the purpose of delivering materials to be used in the repair, alteration, remodeling, or construction of any such home, building or structure for which a building permit has been obtained, or for loading and unloading.

The registered owner of any such vehicle shall be presumed to be the operator of such vehicle.

Any violation of this section shall be a Group IV violation of the parking regulations as set forth in Section 14-17 below, which are enforced by the Milford Police Department. Each day a violation shall continue or occur shall constitute a separate violation.

For purposes of this section, the following definitions shall apply:

CAMP TRAILER

Any trailer designed for living or sleeping purposes and used exclusively for camping or recreational purposes;

CAMPER

Any motor vehicle designed or permanently altered in such a way as to provide temporary living quarters for travel, camping or recreational purposes.

COMMERCIAL VEHICLE

Any vehicle requiring a commercial driver's license ("CDL");

Any motor vehicle which exceeds a gross weight rating in excess of 10,000 pounds or has two rear axles or more and a manufacturer's rated capacity of more than one ton or a length of more than 21 feet measured from the extremes of the vehicle, including any object loaded on the vehicle or a height of more than eight feet with properly inflated tires, measured from the ground to the highest part of the vehicle, including racks, but not antennas; or

Sec. 14-16 Exemption for clergymen, physicians and emergency vehicle operators.

Vehicle, with the exception of those used and housed at approved school or house of worship, designed to transport 16 or more passengers, including the driver.

Excluded are station wagons, compact-type bus vehicles and pickup trucks used for private transportation.

MOTOR HOME

A vehicular unit designed to provide living quarters and necessary amenities which are built into an integral part of, or permanently attached to, a truck or van chassis;

RECREATIONAL VEHICLE

The camper, camp-trailer and motor-home classes of vehicles;

SEMITRUCK-TRAILER

Any trailer-type vehicle designed and used in conjunction with a motor vehicle so that some part of its own weight and load rests on or is carried by another vehicle.

TRAILER

Any rubber-tired vehicle without motive power drawn or propelled by a motor vehicle.

Nothing in this article shall be construed as prohibiting a clergyman, physician or the operator of any emergency vehicle from parking a motor vehicle at any time on any street or highway or in any parking lot in the City while engaged in the performance of his duties upon the occasion of any emergency.

Sec. 14-17 Categories, fines for parking violations.

The violations of parking regulations as established by ordinance or rules and regulations of the Police Commission shall be categorized by the Police Commission as Group I, II, III, IV or V violations. The fine for each violation shall be as follows:

Sec. 14-18 Parking at public high schools restricted; penalty for violation.

At any time between the hours of 7:00 a.m. and 2:10 p.m. on any day when school is in session, it shall be unlawful for any vehicle to stand or park in any parking area at Milford's public high schools, except in accordance with the following regulations:

Sections within the parking areas at each school shall be designated for faculty-staff, students and visitors;

Each faculty or staff member or student wishing to park a vehicle in the school parking area shall obtain from the principal of the school, or the principal's designee, a sticker which shall designate the section in which the vehicle may be parked;

Said sticker shall be affixed to the vehicle in accordance with the instructions of the principal of the school or the principal's designee;

It shall be a violation of the provisions of this section to park a vehicle in a designated section of the parking area unless the vehicle displays a sticker authorizing parking in said section;

Visitors to any school shall be exempt from the provisions of this section provided that their vehicles are parked in the section designated for "Visitor Parking."

Sec. 14-19 through Sec. 14-23. (Reserved)

Anyone violating the provisions of this section shall be subject to a fine of $5 for each violation.

DIVISION 2 IMPOUNDMENT AND TOWING OF ILLEGALLY PARKED VEHICLES

Sec. 14-24 Authorization.

The Police Department, and all members thereof, are hereby authorized to remove and tow away, or cause to be removed and toward away, by commercial towing service, any car or other vehicle illegally parked in any place where such parked vehicle creates or constitutes a traffic hazard, blocks the use of a fire hydrant, or may obstruct the movement of any emergency vehicle; or any motor vehicle parked on a public street within the City at any time during, or within 12 hours after a snowfall of three inches or more has occurred. Such removal shall be at the risk and expense of the owner of the vehicle.
