(A)
Permit required. It shall be unlawful and a violation of this section for any person to operate, fly or use a motor operated model airplane within the boundaries of Eisenhower Park without a permit, issued by the Public Safety and Welfare Committee of the Board of Aldermen.
(B)
Operation. Any person receiving such a permit shall conform to the following regulations:
(1)
Flying over private property is strictly prohibited and the City reserves the right to establish a flight pattern.
(2)
There shall be no more than three model airplanes airborne at any one time in the park.
(3)
The model airplane operating permit shall be valid for one year from the date of issuance.
(4)
No model airplanes shall be operated on Memorial Day, the Fourth of July or Labor Day.
(5)
The permit for flying shall be carried by the permittee while using the parking for flying purposes.
(7)
No model airplane shall be operated in such a way as to endanger public or private property or safety.
(C)
Posting of regulations; availability of permit applications. A copy of this section shall be posted at Eisenhower Park and copies shall be available and on file at the office of the City Clerk and/or the legislative aide of the Board of Aldermen. Permit applications shall also be available at such office and/or at the City Clerk's office.
(D)
Penalty. Violation of any provisions of this section shall be punishable by a fine not exceeding $100 in accordance with Section 1-9 of this Code of Ordinances and/or by automatic revocation of the violator's permit.
(E)
Subject to prior Board of Aldermen approval on a yearly basis, the Model Airplane Club may hold an annual picnic at Eisenhower Park one Sunday per year during which the flying of model airplanes will be permitted from noon until dusk, subject to the limitations contained in Subsections (A) and (B) hereof.
