The purpose of this chapter is to provide for the Fiesta del
Valle de Española, to achieve participation in the various
fiesta events by the civic-minded citizens of this community and to
provide centralized supervision over persons who sponsor, conduct
or manage the various fiesta activities, and to ensure fiscal and
financial responsibility on the part of those who solicit and collect
fees, assessments and contributions from the people of the City. This
chapter is adopted for the purpose of promoting and protecting the
public safety, health and welfare of the community, and shall be liberally
construed to carry out its purposes.
The following words, terms and phrases, when used in this chapter,
shall have the meanings ascribed to them in this section, except where
the context clearly indicates a different meaning.
- FIESTA COMMITTEE
- A committee consisting of the Mayor and two members of the Fiesta Council, appointed under the terms of this chapter.
- FIESTA COUNCIL
- A council appointed by the Mayor, with the advice and consent of the City Council, under the terms of this chapter.
- FIESTA DEL VALLE DE ESPAÑOLA
- The annual public celebration held in this City to commemorate and celebrate the initial conquest of New Mexico by Captain Juan de Oñate in July 1598, and the establishment of his capital at San Gabriel de Los Españoles, at the confluence of the Rio Chama and the Rio Grande del Norte.
There is hereby created a Fiesta Advisory Council, called "Council"
in this chapter, which shall consist of 20 members to 40 members to
be appointed by the Mayor with the advice and consent of the majority
of the membership of the City Council. The Mayor shall designate the
Chairman of the Council, and the Council shall meet as often as is
necessary in the discretion of the Chairman to discharge its duties
and shall promulgate its own bylaws and regulations, subject to the
approval of the Fiesta Committee.
There is hereby created a permanent committee to be known as
the "Committee on the Fiesta del Valle de Española," called
"Fiesta Committee" in this chapter, which shall consist of the Mayor
as Chairman and two other members of the Fiesta Advisory Council to
be appointed by the Chairman of such Council. The Fiesta Committee
shall in its discretion delegate duties and responsibilities as required
to the Fiesta Council in order to accomplish the purpose of this chapter.
The Fiesta Committee shall report regularly to the City Council.
All property acquired by the Fiesta del Valle de Española
Fiesta Committee shall be the property of the City.
The City may delegate to a nonprofit corporation created for
such purpose all rights, powers and duties authorized by this chapter.
