As used in this chapter, unless the context or subject matter otherwise requires, the following terms shall have the meanings indicated:
DRIVER'S LICENSE
Permission granted by the Village to any person to drive upon the streets of the Village any licensed taxicab.
OWNER
Any person, firm or corporation, or association owning and operating one or more taxicab(s).
TAXICAB
Any motor vehicle with a maximum capacity of seven or fewer passengers, including the driver, engaged in the business of carrying persons for hire, whether the same be operated from a street stand or subject to calls from a garage, or otherwise for hire, except vehicles subject to the provisions of the Transportation Corporation Law or used by undertakers in carrying on business.
TAXICAB DRIVER
Any person who drives a taxicab, whether such person be the owner of such taxicab or employed by an owner or another taxicab driver.
It shall be unlawful for any person to drive a taxicab within the Village of Delhi without a taxicab driver's license for driving the same, as provided herein, whenever said vehicle is operated as a taxicab.
Each applicant for a taxicab driver's license must comply with the following:
A. 
Form. Each applicant shall file his or her application with the village clerk on forms to be adopted by the village clerk.
B. 
State license. The applicant shall have a state chauffeur's license.
C. 
Age. Applicants must be of the age of 18 years or over.
D. 
Addiction to liquor. The applicant shall not be addicted to the use of intoxicating liquor or drugs.
E. 
Personal history.
(1) 
The applicant shall fill out, upon a blank form to be provided by the village clerk, a statement giving:
(a) 
The applicant's full name and residence.
(b) 
The identification number and make of the vehicle.
(c) 
The year manufactured.
(d) 
New York State license number.
(e) 
Proof of a current New York state inspection.
(f) 
Place of birth.
(g) 
Whether the applicant is a citizen of the United States.
(h) 
Places of previous employment.
(i) 
Whether the applicant has ever been convicted of any felony or misdemeanor, including but not limited to DWI, or of a DWAI, and, if so, the date of such conviction and the disposition thereof.
(j) 
Whether the applicant has been previously licensed as a driver or chauffeur and, if so, whether his or her license has ever been revoked and for what cause.

Whether the applicant must periodically register, for any reason, with the Department of Criminal Justice Services.
(2) 
This statement shall be signed and sworn to by the applicant and filed with the Village Clerk as a permanent record.
F. 
Waiting period. In order to ensure compliance with all requirements mandated by this chapter, a minimum of five business days must elapse before a taxicab driver's license may be issued by the Village Clerk.
G. 
Payment of fees. Each applicant must pay the required fees as set forth herein.
Each applicant for a taxicab driver's license must file with his or her application three unmounted, unretouched photographs of himself or herself taken within the 30 days preceding the filing of his or her application. The photographs shall be of a size which may be easily attached to his or her license; one shall be attached to his or her license when issued and the others shall be filed with the application.
Each applicant for a taxicab driver's license must submit with the application form a New York State Department of Motor Vehicles abstract providing information regarding the applicant's past and current driving record. The cost of said abstract shall be borne by the applicant.
A. 
Licenses shall be issued by the Village Clerk annually for a period beginning June 1 and expiring May 31 of the following year.
B. 
Each licensed driver of a taxicab shall display his or her taxicab driver's license and photograph in the interior of the taxicab in such position that the same may be easily seen by any fare at all times when the licensed driver is operating the taxicab.
Application for renewal of taxicab licenses shall be filed not later than May 15 of each year with the Village Clerk.
The fee for a taxicab license shall be set by resolution from time to time by the Village Trustees of the Village of Delhi for each taxicab owned and operated by an applicant.
In the event that the owner of one or more taxicabs shall dispose of his or her taxicab or taxicabs and obtain a new taxicab or taxicabs, the license for the motor vehicle or vehicles so disposed of may be transferred to the new taxicab or taxicabs upon application and notice to the Mayor and providing the information as set forth herein by filing the same in the Village Clerk's office, or a new license or licenses may be issued for the new taxicab or taxicabs.
Every license issued pursuant to this chapter shall be countersigned by the Village Clerk, who shall keep a record thereof and the amount of the fee to be paid therefor.
A. 
Generally. It shall be unlawful for any person to operate or permit a taxicab to be operative within the Village unless said taxicab shall be covered by a liability insurance policy for the protection of passengers in an amount to be determined by the taxicab company's insurance carrier. Proof of insurance shall be required for all vehicles operating as taxicab and shall be filed with the Village Clerk before a taxicab license is issued.
B. 
Change of vehicles. Whenever any vehicle is replaced by another vehicle, before the new vehicle shall be operated as a taxicab, proof of insurance as required by Subsection A of this section shall be submitted to the Village Clerk.
A. 
Taxicab owner's license. An owner's license may be suspended or revoked at any time by the Village Clerk for a violation of this chapter, or if a licensed owner is twice convicted within a period of six months of a violation of any federal or state law or Village ordinance relating to the operation of motor vehicles, or if any one licensed driver of a licensed owner is convicted of a violation of this chapter twice within a period of six months, or is three times convicted within a period of six months of a violation of any state law or Village ordinance relating to the operation of motor vehicles. Whenever any owner's license is revoked or suspended, it shall be surrendered to the Village Clerk. In the case of a suspension, the license shall be retained by the Village Clerk until the suspension expires, and in case of a revocation, the license shall be destroyed by the Village Clerk. In the event that any person to whom an owner's license is issued has such license suspended on three separate and distinct occasions within a period of 18 months, the third suspension shall automatically result in a revocation.
B. 
Taxicab driver's license. A taxicab driver's license may be suspended or revoked at any time by the Village Clerk for a violation of this chapter and must be revoked if the driver is convicted of or indicted for a felony or misdemeanor involving moral turpitude or upon two convictions within a period of six months of a violation of any of the traffic laws of the State of New York or ordinances of the Village. In cases of suspension or revocation, the license shall be surrendered to the Village Clerk. Upon termination of the suspension, it shall be returned to the licensed driver. Upon revocation, the license shall be destroyed by the Village Clerk. A third suspension within a period of 18 months shall result in an automatic revocation of license.
The Village Clerk shall keep with the original application a complete record of each license issued to a driver and of all renewals, suspensions and revocations thereof.
Any person who shall violate any provision of this chapter shall be punished by a fine not to exceed $100 for each violation. A separate violation shall occur each day that any such owner shall be in violation of the provisions of this chapter.
A. 
The provisions of this chapter are severable, and the invalidity of a particular provision shall not invalidate any other provision(s).
B. 
This chapter shall take effect immediately upon filing in the office of the New York Secretary of State.
