If the water level in the Village of Walden Well No. 6 is at or within 7 1/2 feet from breaking suction, the chief executive officer or the Board of Trustees of the Village of Walden may declare a Stage I water emergency if, in said officer's or Board's opinion, such a declaration is necessary to protect the public health and safety. In the event of an emergency declared by the chief executive officer, said emergency shall be sustained or overruled by the Village Board at the next regular meeting following the declaration or at a special meeting called for emergency purposes. During a Stage I water emergency, the following uses of water shall be prohibited:
A. 
Serving of water at a food service establishment except at the specific request of a patron.
B. 
The use of water for washing of paved surfaces, including but not limited to streets, roads, sidewalks, driveways, garages, parking areas, tennis courts and patios.
C. 
The use of water for nonagricultural irrigation and watering of lawns, flower gardens, landscaped areas, trees, shrubs or outdoor plants.
D. 
The use of water for ornamental purposes, including but not limited to fountains, artificial waterfalls and reflecting pools.
E. 
The use of water for noncommercial washing or cleaning of automobiles, trucks, trailers or any other vehicle.
F. 
The use of water from a fire hydrant except for firefighting or public health protection.
G. 
The use of water for flushing of sewers or hydrants except as deemed necessary for the public health and safety.
H. 
The use of water for any purpose other than that which is required to protect the public health and safety.
I. 
The use of water or steam for the cleaning of buildings or any other structure's exterior.
J. 
The use of water for the filling or the operation of a swimming pool, partly artificial swimming pool, bathing beach or any swimming facility or for the operation of an ice-skating rink, except any municipal facility.

If the water level in the Village of Walden Well No. 6 is at or within 3 1/2 feet from breaking suction, the chief executive officer or the Board of Trustees may declare a Stage II water emergency if, in said officer's or Board's opinion, such a declaration is necessary to protect the public health and safety. During a Stage II water emergency, the following uses of water shall be prohibited:
A. 
The use of water as set forth in § 298-35.
B. 
The use of water for the commercial washing or cleaning of automobiles, trucks, trailers or any other vehicle by facilities which do not recycle water.
C. 
The use of water in a commercial or industrial facility in excess of 75% of said commercial or industrial user's average daily consumption for the immediately preceding 12 months. When the immediately preceding 12 months' daily average consumption for said user is not available, the average daily water consumption of said user for the 90 days immediately preceding the declaration of the Stage II emergency shall be used.

If the water level in the Village of Walden Well No. 6 is at or within two feet from breaking suction, the chief executive officer or the Board of Trustees may declare a Stage III water emergency if, in said officer's or Board's opinion, such a declaration is necessary to protect the public health and safety. During a Stage III water emergency, the following uses of water shall be prohibited:
A. 
The use of water as set forth in §§ 298-33 and 298-34.
B. 
The use of water in a residence in excess of 50 gallons per resident per day.
C. 
The use of water in a commercial or industrial facility in excess of 50% of said commercial or industrial user's average daily consumption for the immediately preceding 12 months. When the immediately preceding 12 months' daily average consumption for said user is not available, the average daily water consumption of said user for the 90 days immediately preceding the declaration of the Stage III emergency shall be used.
D. 
The use of water for residential agricultural purposes.
E. 
The cessation of use of water for any purpose depending upon water availability which will ensure sufficient water for sustaining human needs.
F. 
No building permits for construction of new structures shall be issued.
The chief executive officer may, upon receipt of a written application on a form prescribed by him, grant a variance from any of the prohibitions of the use of water as proscribed herein when, in his opinion, such a variance would be in the general public interest and would not unnecessarily endanger the public health and safety. Any party aggrieved by any determination of the chef executive officer herein may appeal such determination by submitting to the Board of Trustees a notice of appeal on a form prescribed by the chief executive officer.
A. 
Notwithstanding the earlier sections, if a problem develops in the water supply or distribution system which causes a depletion of storage in the distribution storage tanks or reduces or totally interrupts the supply from any or all of the Village wells, the chief executive officer or Board of Trustees may declare a water emergency if, in his or its opinion, such a declaration is necessary to protect public health and safety during such a water emergency.
B. 
The chief executive officer or Board of Trustees has the right to shut off the water or decrease pressure to any and all water customers without notice or to take any other actions deemed necessary to protect the public health and welfare.
