As used in this article, the following terms shall have the
meanings indicated:
PESTICIDE
A.
Any substance or mixture of substances intended for preventing,
destroying, repelling or mitigating any pests; and
B.
Any substance or mixture of substances intended for use as a
plant regulator, defoliant or desiccant.
PLANT REGULATOR
Any substance or mixture of substances, intended through
physiological action, for accelerating or retarding the rate of growth
or rate of maturation or for otherwise altering the behavior of ornamental
or crop plants or their produce, but shall not include substances
which are intended as plant nutrients, trace elements, nutritional
chemicals, plant inoculants and soil amendments.
Unless the use is classified as an exception under §
7-3, the application of pesticides or plant regulators to any Town-owned parcel of land is hereby prohibited.
If any clause, sentence, section, paragraph or provision of
this article or any rule or regulation hereunder shall be adjudged
by a court of competent jurisdiction to be invalid, such judgment
shall not affect, impair or invalidate the remainder of this article
but shall be confined in its operation to the clause, sentence, section,
paragraph or provision or rule or regulation directly involved in
the controversy in which such judgment shall have been rendered.
This article shall take effect immediately upon the filing thereof
in the office of the New York Secretary of State.
