No person shall consume alcoholic beverages or possess the same
in any opened or nonoriginal containers in any public place, as herein
defined, unless special permission shall have been given therefor
by the Municipal Council.
As used in this article and the enforcement hereof, the following
terms shall have the meanings indicated:
PUBLIC PLACE
Any public park, playground or publicly owned property or
any public street, walkway, alley or parking area or any place or
area to which the public or a substantial group has access, whether
publicly or privately owned, except that where the premises are privately
owned and the conduct otherwise prohibited by this article is at the
invitation or with permission of the owner, lessee or other person
exercising control or management of the premises or the business being
conducted thereon, such conduct shall not be deemed a violation hereof.
Any person found guilty of a violation of this article shall,
upon conviction thereof, be subject to a fine not to exceed $1,250,
or imprisonment for a term not to exceed 90 days or a requirement
to perform community service for a period not to exceed 90 days.
Nothing contained in this article is intended or shall be interpreted
to limit, restrict or curtail the operation of any business duly licensed
under applicable laws governing the sale and consumption of alcoholic
beverages or to otherwise modify the laws governing the operation
of said businesses.
