There shall be a Borough Engineer who shall be appointed by
the Mayor, with the advice and consent of the Municipal Council, to
serve a term of three years, not to exceed the term of the Mayor.
The Borough Engineer shall be a professional engineer duly licensed
in the State of New Jersey and having held such license for not less
than five years.
The duties of the Division shall be performed by or under the
supervision of the Borough Engineer and shall include all municipal
engineering services requested to be performed by the Municipal Council
or Director of Public Works and such duties described or referred
to in the laws of the State of New Jersey governing municipalities
and counties, N.J.S.A. 48:1-1 et seq. and 40A:1-1 et seq. and may
include:
A. Attendance at meetings and rendering assistance and advice to the
Municipal Council, Planning Board and other boards or agencies of
the Borough.
B. Design and preparation of plans and specifications for municipal
improvements and supervision of construction thereof.
C. Inspection of public improvements and boundary monuments installed
by developers as required by the Planning Board and such services
in connection with development applications as may be required or
appropriate.
D. Such other special engineering or planning projects as may be assigned.
The office of Borough Engineer shall not be a full-time position,
and the above duties may be performed by the Borough Engineer or by
any partner, associate or employee of the Borough Engineer acting
under the supervision and control of the Borough Engineer, who shall
nonetheless remain responsible for all such engineering services performed
by others.
The compensation to be paid to the Borough Engineer shall be
agreed upon, in writing, prior to the performance of such duties and
shall in no event be based upon a percentage of the cost of construction
or contract price of the project for which such services are rendered.
Such agreement shall provide a fixed fee or hourly rate and shall
be based upon actual time and expenses.
