All improvements required by the Planning Board shall be performed to conform to the design criteria and site improvement specifications in §§ 240-26 and 240-27 hereof. Minimum street width shall be 50 feet, of which minimum pavement shall be 24 feet. The requirement for curbs and gutters and such other items as streetlights, street trees and recharge basins may be waived in whole or in part if, taking into consideration the prospective character of the development or the special circumstances of a particular plat or plats, the Planning Board judges that such improvements are not requisite in the interest of public health, safety and general welfare.
A. 
Inspections. All required subdivision improvements shall be subject to inspection by an authorized representative of the Village. The developer shall notify this representative at least seven days prior to the start of the following phases of construction:
(1) 
Road subbase and shoulders.
(2) 
Drainage pipe and other drainage structures before backfilling.
(3) 
Road paving.
(4) 
Fencing.
(5) 
Landscaping.
B. 
Changes in the performance bond.
(1) 
The term of the bond may be extended by the Planning Board with the consent of the parties thereto.
(2) 
At any time during the term of the bond, the Planning Board may modify its requirements, reduce or increase accordingly the face value of the security, or declare the bond to be in default and collect the sum payable thereunder, following the procedures described in § 179-l of the Village Law.[1]

C. 
Release of the performance bond.
(1) 
Upon completion of the required work and prior to the termination of the performance bond period, the developer's engineer shall make an as-built survey of the required subdivision improvements. This information shall be incorporated on the final road and drainage plans to ensure that the required improvements have been constructed in accordance with the plans as previously approved.
(2) 
The following certification shall be placed on the plans and signed by the developer's engineer or land surveyor:
"I hereby certify that this plan shows locations, profiles and elevation of roads, curbs, drainage and other structures as actually constructed and that the information shown hereon is obtained from an actual field survey."

(3) 
The as-built plan shall be submitted to the Planning Board and approved before the performance bond will be released. After the completion of all work and the submission of the as-built plans, authorized representatives of the Village will make a final inspection to determine whether the completed improvements are in accordance with the approved drawings and specifications. Upon a satisfactory final inspection report, action will be taken to release the developer's performance bond.
At the time of the release of the performance bond, a surety bond or certified check, made payable to the Village, shall be furnished by the developer to guarantee the workmanship and materials of all public improvements for a period of one year from the date of acceptance by the Village. This bond or certified check shall be in an amount which is 1/3 of the performance bond estimate.
