As used in this article, the following terms shall have the
meanings indicated:
BICYCLE
Referred to as "pedalcycle" and, as used in this article,
shall mean and include any device propelled solely by human power.
"Pedalcycle" is further defined as a vehicle with at least two wheels,
front and back, with a seat or saddle between and propelled by means
of pedals working on a crankshaft.
Every person riding a pedalcycle upon any roadway or sidewalk
shall be granted all of the rights and shall be subject to all of
the duties applicable to the driver of a vehicle by virtue of Part
III, Chapter 35, Subchapter A, of the Vehicle Code, which subchapter is incorporated herein by reference and
made a part hereof as if each and every provision contained therein
were set forth herein at length.
Any person who violates this article shall, upon conviction
thereof, be punishable as provided in 75 Pa.C.S.A. § 3502.

Except where the context clearly indicates otherwise, the following
terms, as used in this article, shall have the following meanings:
BICYCLE
A vehicle with two wheels, propelled solely by human power
and having pedals, handlebars and a saddle-like seat. This term also
shall include any such human-powered vehicle designed for operation
by two or more persons and having multiple tandem seats and corresponding
sets of pedals.
IN-LINE SKATES
Roller skates whose wheels are arranged in a straight line.
SCOOTERS
A light two-wheeled open motor vehicle on which a driver
sits over an enclosed engine with legs together and feet resting on
a floorboard.
SKATEBOARD
A vehicular device consisting of a platform constructed of
wood, fiberglass or other similar material to which are affixed a
number of paired wheel assemblies ("trucks") and which is ridden by
standing upon said platform and propelled by the rider, in the manner
of a scooter, by pushing the foot against the ground.
No person under the age of 16 years shall ride, either as the
operator or as a passenger, a bicycle or skateboard unless said person
is wearing a properly fitted and securely fastened bicycle helmet
which meets the standards of the American National Standards Institute
(ANSI 290.4, Bicycle Helmet Standard) or the Snell Memorial Foundation's
1984 "Standard for Protective Headgear for Use in Bicycling." This
requirement also shall apply to any such person who rides as a passenger
on a bicycle while in a restraining seat which is attached to the
bicycle or as a passenger in a trailer towed by a bicycle. Individuals
engaged in in-line skating or using a scooter are required to wear
helmets when under the age of 16.
Any person who shall violate the terms of this article shall
be warned of said violation by the enforcing official of the Borough.
The parent or legal guardian of said person also may be fined a maximum
of $25 for the violator's first offense, together with the costs
of prosecution, or a maximum of $100 for each and every subsequent
offense, together with the costs of prosecution. The prescribed fines,
as imposed pursuant to this section, may be waived, provided that
the violator and/or his/her parent or legal guardian is able to present
proof, as may be acceptable to the enforcing official, that an approved
helmet was owned at the time of any such violation or has been purchased
subsequent to the occurrence of a violation.
