The above recitals[1] shall form a part of this article as fully as though the same were set forth hereinafter at length.

Should there be a motor vehicle accident on an East Allen Township roadway or state highway within the municipal boundaries of East Allen Township, whereby one or more individuals receive fatal injuries, the placement of an appropriate memorial at or near the location of the accident shall be permitted under the following conditions:
A. 
There shall be a limit of one memorial for the individual who suffered fatal injuries.
B. 
The placement of the memorial shall not be within the PennDot or Township right-of-way and shall be set back no less than three to five feet from the said right-of-way after receiving permission from the property owner.
C. 
The memorial may include the placement of an artificial floral arrangement adjacent to the memorial.
D. 
Visitation to the memorial site shall be at locations outside of the road right-of-way which shall be no closer than three to five feet from the road cartway.
E. 
The memorial and all supportive flowers and/or memorabilia shall be removed from the site not later than 30 calendar days following the date of the fatal motor vehicle accident.
F. 
Should the memorial and all supportive flowers and/or memorabilia not be removed at the end of the thirty-calendar-day period, the Township will either remove or cause the removal thereof. Upon the removal of such items, the Township shall have no responsibility for the storage or safekeeping of such items, and may dispose of such items.
G. 
This article shall be applicable to all memorials in existence on and also those that come into existence after the effective date of this article. For all memorials in existence on the effective date of this article, the memorials and all supportive flowers and/or memorabilia shall be removed from the site not later than 30 calendar days following the effective date of this article, and should the memorial and all supportive flowers and/or memorabilia not be removed at the end of the thirty-calendar-day period, the Township will either remove or cause the removal thereof. Upon the removal of such items, the Township shall have no responsibility for the storage or safekeeping of such items, and may dispose of such items.
