The purpose of this article is to further promote the vision, goals, and recommendations outlined in the Town of Austerlitz's Comprehensive Plan for encouraging small, traditional businesses throughout the community.
Level 1 home occupations:
A. 
Shall be conducted in a manner which does not give the outward appearance of a business.
B. 
Shall be conducted within the home or accessory structure. Such use shall not alter the external appearance from a residential character.
C. 
Shall not generate automobile or truck traffic that would exceed the volume of traffic that would otherwise be generated by typical residential use.
D. 
Shall have no external storage of materials, equipment, containers, finished products or associated vehicles outside the home, outbuilding or garage other than that which is normally associated with residential use.
E. 
Shall be incidental and secondary to the use of a dwelling unit for residential purposes. Such uses shall occupy an area no greater than 25% of the gross habitable area on the lot. The space occupied by the home occupation itself does not necessarily have to be in the habitable area.
F. 
Shall be limited to two per lot and shall not have any nonresident employees.
G. 
Shall display no sign or other indication of the home occupation.
A. 
Level 2 home occupations are traditional, small-scale, rural commercial activities that the Comprehensive Plan encourages.
B. 
Level 2 home occupations are considered business uses and are permitted in all districts in existing and new homes and outbuildings, including barns and garages, subject to the following:
(1) 
All Level 2 home occupations shall:
(a) 
Be conducted by a resident of the lot.
(b) 
Avoid excessive noise, traffic, nuisance, fire hazard, glare, and other adverse effects of business uses.
(2) 
All Level 2 home occupations shall comply with the following criteria and standards:
(a) 
Home occupations shall be limited to two per lot.
(b) 
Home occupations shall be incidental and secondary to the use of a dwelling unit for residential purposes. Such uses shall occupy an area no greater than 50% of the gross habitable space of the dwelling unit. The space occupied by the home occupation itself does not necessarily have to be in the habitable area.
(c) 
Each home occupation shall have only one sign which is in conformance with Chapter 70, Advertising Devices, of the Code of the Town of Austerlitz.
(d) 
Each home occupation shall allow no more than two nonresident assistants, interns, or employees at any one time.
(3) 
Persons proposing Level 2 home occupations shall submit a certification to the Code Enforcement Officer, on forms provided by the Code Enforcement Officer, providing information about the activity and demonstrating compliance with requirements of this subsection.
